Somone told me that for K1 Visa the petitioner alone must meet minimum income requirements and CANNOT have a co-sponsor. Is this true?

3AD

I am having the same issue as you are 3AD. My fiancee got deny twice already. I don't know what to do as of this time. I might ask for help from the state's senators. Hope they can give a voice about our problem.

I think it is true 3AD. I have my dad as a joint sponsor and that ain't work out either

For sure that I will go back to Vietnam and get marry then file K-3. That will take another year and a half for us to be with each other 4ever. It kinda such but you have no other choice.

I asked you this question in the K-1 forum but you didn't answer.

What does the green 221(g) denial letter say? What exactly does it ask for?

I went through HCMC with a co-sponsor and passed.

If you need a co-sponsor now, you will need one with a K-3. You should find out the exat reason for denial and try to correct it. Even if you file K-3, there is no guarantee you will pass. Being married is not a guarantee for any visa.

True, there is NO guarantee by getting married will lead to Visa issuance, but it is the next option. I must say, you're right about not to get over the simplest thing... asking Duc_Uyen what were noted on their 221(g) is a good question.

Usually they do not just flat-out deny one's case. Is it a DENY/REJECT/RETURN or DELAY, requesting for more evidence/information? Please be clear on this... Another tool you can use is contacting your Congressman to intervention.

Please, come back with detail reason why they "deny" your case (i hope it's just a DELAY)

Welcome newbies....it sucks that a little while back the powers that be here decided to erase all the threads for some reason. (maybe a good reason..maybe bad..I don't know.) ...there was ALOT of good stuff that used to on here including SEVERAL posts from an immigration attourney who specialized in VN cases and an actual consulate officer who had been posted at HCMC untill recently...That doesn't even include all the valuable input from all off the members who went through HCMC already. ...Anyhow...I still come back here from time to time to see what is going on and would be more than happy to help out if need be. Good to see chuck and kim still here...probably few other vets around as well to help out. Good luck to everyone.

A short timeline:

October 2003, Introduced to YEN by her cousin whom I work with. We like each other etc etc etc..and so on

February 3, 2004, I go to Vietnam to meet her. Things go well so on

February 9, 2004, we get engaged and have the big ceremony and then on

February 14, 2004, I get back on the plane and come home. By about the middle of May I have everything ready to send in to USCIS for the I-29 and on

May 18, 2004 the Nebraska service center recieves the petition. And on

August 28, 2004 I recieve approval notice from NSC. On

October 18, 2004, Yen recieves Packet 3, fills it out, turns it in and on

December 13, 2004 Yen recieves Packet 4, she takes care of it, does the medical etc etc and the interview is scheduled for

January 4, 2005. Yen arrives for her interview and FAILS! So I call and find out what went wrong and they require additional evidence including a 5 minute video of me speaking vietnamese, a tax document that was already in the file, and some letters from me about how and when we met, when and where the engagement was, things we have in common and how our relationship progressed. So on

February 25, 2005 I go back to Vietnam to visit my em oi and on

March 2, 2005 she and I go to the consulate to give them the Video etc. They tell us to expect to wait another 2-6 months. I decide on

March 10, 2005 to give the consulate copies of my airplane tickets, visa and ticket stubs for Yen and I's trip to Phu Quoc. Unexpectedly on

March 23, I get an email from the consulate telling me that our case is APPROVED! So on or about

April 25, 2005 Yen arrives in Kansas City, MO, USA!

Now going through the rest of the process here.

I'm not too happy with yellow either. I can't believe his case has been sitting in HCMC since December without pack 3 being issued. Maybe he got cold feet. He hasn't been to VisaJourney since January. If Matt or any of you other NOA2s get to HCMC before I hear from him again, he will be banished from the list.

Hello everyone. Sorry, It's been a while since I posted in the forum because I just got back from VN. I graduated in January and immediately booked tickets to go see my fiancee in Hue since I couldn't bare being apart no longer. The two months that I spent with her was the most fun i've ever had in my life. To update on our status, we never did receive our pack 3. Lien met me in Saigon for my arrival and we both went to the embassy to pick pack3 up. I think that was on Jan. 20th. We took pack3 back to Hue and sent it out on Feb. 10th. Lien called in to check our status again about 2 weeeks ago, and they told her to call back in April to know her medical exam date and interview date. I just got back about a week or so, and she's been crying everyday. I told her not to be so sad so we could have the energy to wait for each other. Anyways, it's nice to be back in the forum.

I've been pretty quiet on VJ lately.... Just to let you all know. Lan (my fiance) has her interiew in HCMC on March 29. I've already sent her all the documents/materials needed for the interview. I know HCMC is a difficult consulate to deal with but we are pretty damn well prepared! Wish us luck and I will post a followup after the interview.
