What to do if K1 visa is denied?

Timeline

Our K1 visa was denied for my Filipina fiance. What are our options?

The denial was most probably because my fiance is 40 and I'm 70.

If a K1 visa is denied, does that mean a K3 petition after that will automatically be denied?

We saw that an appeal can be filed within 33 days after the denial. Who should file an appeal, my Filipina fiance or me the petitioner?

Call your senator immediately and get him involved. First thing is to find out why she was denied. Try and keep your petition at USEM as if it's sent back to the USCIS you may as well start over.

I'm just guessing you/she was denied do to lack of proof of a bona fide relationship. Large age gap isn't the only reason. LOTS are approved with larger age gaps than yours.

July 6 Sad day!! craig flight going back

July 15 K1 visa starts..send the petition CSC

July 24 check cash

July 25 Got our NOA1 hard copy.. yay!!

July 28 touch

Nov 9-14 Second visit..

Nov. 26 Approve online

Dec 2 case forward to USEM

Dec 3 got the NVC letter

Dec 18,22 Medical Exam.. PASSED!

Jan.13 Interview... PASSED!

Jan 15 Visa on hand!! soooooooo happy

Feb 5 Flight.....philippine time

Feb 5 Thanks God....wer happy together forever..

Feb 21....2009 Wedding

April, 2 2009 Applied AOS

April 28, Biometrics

April 29 Case transfered to CSC[/i][/b][/size]

May 28, 2009 EAD received

Aug. 11, 2009 Greencard received

I am sure they would have to give a more substantial reason than your age difference for denial. Age difference shouldn't be a cause for denial.

If it is a lack of evidence your fiancee should have been given a notice defining the reason for denial and an opportunity to rectify this.

Yeah they did for me on my first denial. My senators office found out right away why my finacee was denied.

Any initial denial is accompanied by something in writing. She was given a paper with an explanation. What does it say.

Nobody is denied for an age difference but the age difference may be a major part of why some are denied for failing to show a bona fide relationship.

You next steps will be determined by what that paper says, so it is critical you get a copy of it.

As pushbrk suggested, you will need to know exactly what was said on the paper she was given. Then contact your Senator's office and perhaps a good immigration lawyer in PI. It's essential you keep your petition in the PI and not let them send it back to the US where it is bound to get lost in a black hole.

Go visit the PI forum here and ask around there.

This has nothing to do with why the OP's petition was denied, and has no place in this thread.

To the OP:

I hope that you can keep the case with the Embassy in PI, and resolve this. I've not heard of anyone here on VJ being denied a visa in PI because of age difference. It probably has the highest ratio of age differences from any of the Embassies. A 30 year age difference at age 40/70 is probably less diverse than an age diffence of say 20/50.

Your petition has been disapproved with some other documents needed reason I definitely dont believe it is an AGE ISSUE. They never looked at the age gap, they are more on the documents you sent. Re check the letter you received, there must be something you missed.

Feb 22 2008 - CSC returned application re: check lost ( actually when he changed new envelope, the check was left in the old envelope :P)

Feb 23 2008 - re sent I 129 application

March 6 2008 - NOA1 by Postal Mail

July 23 2008 - Touched and Petition Approved / sent to NVC

Aug 19 & 20 - Medical Tests @ St Lukes Extension Clinic - PASSED!!!

Aug 26 - Visa Interview ..... PINK SLIP oh GOD thank you so much!

Sept 2 - VISA Packet Delivered !!!

Sept 26 - Cebu - Manila - (POE) San Francisco - St Paul/ Minneapolis, Minnesota

Nov 15 - Our Wedding Day!

Thanks to all for your encouragement and suggestions.

As the American I will appeal my petition ASAP.

What we didn't understand is how to keep the case in the PI as some suggested.

Call your Senator immediately. Google his name for contact or look in your telephone book. When my fiancee was denied my senator jumped in and kept the petition in Manila until I submitted all the additional evidence I had. Unfortunately it wasn't enuf.
