Canadian in the US - No Visa - Married

I just saw your post and wanted to chime in too. We got married in Vegas, exactly like you did (spur of the moment, no parents, etc) after 61 days as well. Weird! Exactly the same amount of time!

You have good evidence of your ties to home. I was a freelancer so had no job to return to, but I had an active cellphone, mortgage, hydro bills, was still paying my MSP, travel insurance valid for XX number of months, etc. They did not ask me at the interview, but I still had a huge file of it. I also had two letters from regular clients stating that they had contracted me for projects.

That is really a bit ridiculous that USCIS sent you the letter asking for evidence of your lawful entry—they should know the deal with Canadians. I did not get stamped on my last visitor visit either.

You are fine with your six months coming to an end because your status is not longer "Visitor" it is "AOS Pending", so you are not going to be out of status.

Also, here is something I read, which MAY or MAY NOT be true. I was pretty paranoid about our quick marriage too.

When assessing intent, USCIS has some guidelines:

Marriage 0-29 days after entry = strong possibility of intent, MUST investigate further

Marriage 30-59 days after entry = definitely question intent

Marriage 60+ days after entry = no intent assumed

From what I understand, this is kind of a guideline they work off, although every situation is different of course.

My boyfriend and I were considering doing this as well. Many times we have joked around about getting hitched in Niagara on one of our many trips back and forth from Columbus to Toronto or vice versa. Lately the jokes have turned into "what if" but were too scared to take that leap incase it backfires on us.

Does anybody know? What if we did just get hitched while passing niagara? Also, anybody know if it would be more beneficial to do it on the Canadian side, or the American side?

As long as you do not enter the US as a visitor with the INTENT to marry and stay and adjust status, you should be fine. If you do enter with the intent to immigrate, then you need to go back to Canada and file.

If you enter as a visitor and decide - after entering - to marry and stay and adjust status, that is allowed. However, you need to be prepared to defend - at interview - your intent upon entry was non-immigrant.

For those who entered as a visitor then just ended up staying (I hope this isn't too personal) did you find work, or just stay at home...I babysit for a friend of my SO, and get to make a few bucks of my own, but its really not the same! How did you handle that?

I haven't received my EAD yet, so im housebound. And it's starting to suck...

08/25/2008 --- AOS package sent to Chicago via Fedex overnight priority mail. Fingers crossed now!

08/26/2008 -- AOS Package received in Chicago, signed for by A.Smith (1 day before my VWP expires!)

"I am kind of confused tho...since April he and I have been going back and forth between the two countries...we hardly ever have trouble at the border, Im always coming to visit for about a week or so, and he the same. I understand that each time I enter the US my 6 month visit status is restarted...this is the longest Ive stayed (Since Jul 29th) and am actually heading home at the end of this month (god knows for how long tho) Im wondering if all this back and forth visiting will actually hinder whatever visa we apply for?"

I could not work—since it is illegal to do so without EAD—so I worked out, did crafts, went to the Library...as soon as I had my work authorization I started working! Be careful working under the table while your AOS is pending; it is the time to try and keep your nose completely clean...

Your six month is not really restarted each time. You are allowed 6 months in every 12 months. Which sounds vague. And it is. Basically you can be denied any time the inspecting officer feels you are spending, overall, more than half the year in the US. It won't hinder your visa approval though—it will help, since you can show you have a genuine relationship and visit each other a lot!

Remember that if you leave and go home now, you cannot come back, get married and apply for AOS from your visitor visa, becasue then your intent to immigrate will have been planned at the time you entered the US. And that is visa fraud. You can get married on this visit and apply directly for AOS if you did not plan it on this visit, and then you are stuck in the US till your Greencard is approved. Or you can get married, leave the US and apply for a sousal visa from Canada. Or you an go hime to Canada and get married there and apply for a spousal visa. or you can go home to Canada, plan a wedding, get married in the US, go home to Canada, and apply for a spousal visa.

The combinations are endless. But the only way for you to stay in the US and apply for your greencard directly from your visitor status is to get married on this trip and then stay till you at least have AP (whether or not to use AP when adjusting this way is a hot topic. I did it and was fine but it is not widely recommended).

Finally, it does not matter whether you get married in Niagra, or the courthouse, or the Grand Canyon or the local 7Eleven. If you want to stay in the US and adjust from a visitor visa, and you had no intent of doing this when you entered, you must marry in the US on THIS visit and you must not leave pretty much until you have your Greencard.

My post is probably a bit confusing, and you ALREADY sound very confused about the process, so I hope I did not make it worse....

I think it may actually HELP your case as it shown an ongoing relationship and you're not just marrying for a green card. When we went in our I-130 our lawyer also sent in years of flight info and bording passes. Visiting the US or Canada is not the problem so you should never expect a problem at the border. It will be more difficult once you are married for him to visit you in the US as legally he can be denied entry which may complicate your processing further.

Hi Christina,

Welcome to VJ, Christina! Hope you find it especially helpful to you too, as the "immigration process" can be overwhelming at times. And well, without the friendly and helpful community of VJ, one would simply be lost in this complicated, long, and somewhat frustrating at times, immigration process....

Don't worry, take it one step at a time, read the information on VJ, and you'll be ok there. Glad you are "soaking in as much as possible", and as you continue to read, you'll learn and know more, indeed!

The other piece of advice I would suggest is: :time: , as that definitely helps here on VJ!

Nice to meet another fellow Canadian and Torontonian too! Likewise, I used to live in Toronto too, and have moved here to New York State, which is close to the border too. So I understand where you come from, in terms of saying that "Canadians are so close", (lol..."Yet so far" at times...). Funny, I moved only a few hours and a few hundred kms/miles away from Canada to the USA, and yet, I have to go through the process of "immigration", sigh....

I've never really had problems at the border before (except that POE time, when the US border officials questioned us for 2hrs, see my timeline on my signature below for more info). And likewise, my boyfriend (now husband) never had any big problems at the border when he came to visit me in Canada before, though they did question him sometimes as he bought stuff over and made many trips over several years. And now when we both cross together to visit Canada from the USA (me as a US Permanent Resident/Canadian Citizen and my husband as a US Citizen), and the other way around, we never had problems either (10 mins, in and out usually, no problems).

But either way, when one visits either country, they should bring as much information as you can showing that you have "ties" back to the country they are living in, no matter how many trips one takes. Otherwise, they're going to be questioned even further at some point or other, especially when crossing frequently.

The many visits won't hinder any visas and/or immigration appliations you will apply for in the future. However, these frequent border crossings are somewhat hard to prove, as land crossings between Canada and the USA don't necessarily require visas. Overall though, if anything, frequent visits will help, as it shows that it is a genuine relationship. And besides (more importantly so), when two people love each other, they want to see each other more, especially if they live so close together, right?

For the record....Canadians are SO much nicer at the border! we get questioned about our intentions and how long were staying, but other than that, nothing! One time they asked us how much value we had approximately and he just sputtered out "priceless"....heh the official rolled his eyes and passed us through! lol

P.S. To Christina:

In my opinion, and based on the information you mentioned in this forum, I don't think that you should do the "Visitor to AOS" route, as you do have "intent" beforehand in getting married, which is "immigration fraud" and you could be "banned/denied" entry to the USA if you are caught doing such, and am unable to prove otherwise when asked by an immigration official.

Instead, you should consider the following immigration options for you instead: K1 (fiance visa, file paperwork in Canada, come to the USA, get married in the USA, file for the AOS afterwards), K3 (spousal visa, file paperwork in Canada, get married in Canada, come to the USA, file for the AOS afterwards), CR (spousal visa, get married in Canada and have all your paperwork filed in Canada, come to the USA).
