Strange that she wasn't charged

Lara my fiance was involved in a car accident 2 days ago. Luckily know one was badly hurt. Lara was in the car waiting for a biker to take a left turn, then !!! BANG!! a female driver went right into her from behind.

The female driver didn't even attempt to brake and hit her at 40 MPH. The whole incident was witnessed by a police officer. Lara's car has approx $6000 damage to it. The police didn't even charge the other driver as there was know one seriously hurt.

Is this standard in South Carolina to be not charged with that type of accident? Even Lara was astounded she wasn't charged for reckless driving.

same here..in alton, they usually write a ticket for the person who rear ends another (waits for a witty remark )

Sounds familiar. A few years ago, I was driving with my wife in the front passenger seat and some over-caffeinated chick turned left from a parking lot without yielding to me (I had right of way) and basically hit us on the left.... she says she didn't see us... the first thing she did was call work and tell them she will miss a meeting, so I assume she had work on the mind and didn't actually see the big black honda accord she was about to run in to... luckily, she wasn't going too fast, and neither was I, so all the damage was to the vehicles and not to the people involved....

The cops never charged her either, even though the report clearly stated cause to be "inattention" on her part.

No, in our case the report didn't call it that - called it "driver inattention" instead. I assume that is somehow less egregious an offense than being reckless?

Accidents are, well, accidents though. And they're always due to either inattention or recklessness, no?

I guess I just never realized that issuing violations was common after an accident has occurred. Your points go up if you're at-fault anyway, so it seems like they're double penalizing.

When I was rearended in FL - they were charged with "following too close".

I was a passenger in CT - and a dog jumped out in front of the car in front of us, they hit their brakes, and my friend rearended them. The cop threw up his hands and said - as far as I am concerned - its the dog's fault. I know I must have hit him with a weird look at at that one. At some point - the report was "amended" and she was also charged with "following too close".

Oh my... Glad that Lara is fine! When I was just starting out to drive, someone told me that in US (or at least in Florida) when you rear-end someone it's always your fault. Correct me if I'm wrong

Nessa I agree with you on that one. She probably also had on a short skirt and was blond. ;):P

isn't driver inattention pretty reckless? I'd say driving at 30mph will texting is more reckless than driving 80mph focussed on the driving
