Does anyone know if I need to file any seperate petition for the minor child of my fiance to travel to the U.S.along with her. Can someone give me factual information.

The child has to be listed on your fiance's K-1 application. They will have whats considered a K-2 . The child will have to have a medical done. ( No bloodwork or exray is needed. ) Your fiance must have written (notarized) permission from the natural father/mother to remove the child from her/his country. Also be sure your fiance brings all custody agreement documentation to her/his interview. If the child is fairly young, the child won't be questioned at the interview. Usually a young child isn't requried to attend the interview.

Children Have Derivative Status

The child of a fiancé(e) may receive a derivative K-2 visa from his/her parent’s fiancé(e) petition. You, the American citizen petitioner, must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé(e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa. If it is long than one year from the date of visa issuance, a separate immigrant visa petition is required.

Remember that in immigration law a child must be unmarried. The stepparent/stepchild relationship must be created before the child reaches the age of 18.

no need of asking permission if the father appreared unknown in BC. we have same questions before when we we're processing k-1. :D

The father ran off when he heard of the pregnancy. The father is listed as unknown on the official birth certificate. Will we still need to get his permission?

Regarding with illegitimate child since the father is unknown to the child's birth certificate, the only docs your fiance needs are .. the child's birth cert. (NSO copy) and your fiance (CENOMAR) Cert. of No Marriage (in NSO paper) as well. that proving, she is a single mother. and never been married with the father of the child and she doesnt need anymore to get a permit to travel from DSWD (Dept. of Social Welfare) only a copy (xerox) of birth cert of the child when they presents theirselves in phil immigration at the airport.

The child's name shud be included in your fiance K1 application with your fiance docs and the childs docs too. And you need to submit a G235 forms( biographical forms) of your fiance and her son seperately and pictures too.

And when it got approved, manila US embassy will sent u packet of forms and invitation for medical and interview namely to your fiance and her son. so you gonna pay 2 medical fee, and 2 visa fee. My son is 4 yrs olds and i tried calling Manila USembassy before going to interview, and they require me to attend the interview with my son and he was asked for 2 questions bcos embassy says whoever name appeared on the interview date should be present in time of medical exmas and speciallywhen interview.

Docs i prepared & was sent a copy to my fiance in start of application & originals we're been brought in time of interview are: My BC, Cenomar, NBI, pictures then my (son) BC, pictures, another copy (xerox) of his BC i showed @ NAIA airport when were about to leave.

children aged 14 and upwards have to attend the interview. Mine were both asked how they felt about moving to the US. Children over the age of 14 have xray and bloodwork done :)
