Hello,

If a beneficiary has previously been included for benefits on a K1 visa application and the applicaton was canceled just prior to an interview, would that have any effect on a current application? The initial application was filed in 2002, approved and sent to the USEM but the beneficiary never scheduled an interview or medical.

Generally no impact except perhaps some additional scrutiny of bona fides. The big unknown is what was in the letter withdrawing the case. If the letter accused the beneficiary of visa fraud, then bigger problem.

Approval by USCIS shouldn't be a problem either way but the Consular officer in a high fraud country like the PI is going to look at the totality of circumstances before granting a visa. They may well look with the assumption of fraud with the responsibility on the couple to overcome that assumption.

Thank you Pushbrk for your advice, as usual it is sound. We have about a five year history of the typical records so hopefully that will be enough.
