I-129f k-3 Vermont Sevice Center

Does anyone have any news or know why they are holding up the i-129f for k-3 at the vermont service center?When i got hold of an officer at the center,she informed they are approving the i-130s fast and leaveing the i-129fs in the case pending wormhole,so that can get get rid of some of the backlog ,thus forcing us to pursue andbe classified as cr1 or cr2 not giving us the oppurtunity to pursue a k-3 she informed me also that it doesnt matter,because the i-130 cr1s are going as just as fast,i know thats a lie!We know the plus and minuses of both,but We werent given the oppurtunity to pursue the k-3 under the life act as i informed the officer of this,that under the life act it is the petitioners right which to pursue,not the uscis thats the law,didnt seem to matter to this officer that law is the law!please if anyone can shed light pleae do so!thank you

We still are!!!

Thank god that immigrant visas are now moving so much faster, but that's not the point.

As Louie pointed out: VSC is apparently de facto treating K-3 visa applications as IR-1/CR-1 applications, by discarding the I-129F and only approving the I-130.

At the same time USCIS websites still list K-3 visas as an option, and other service centers ARE still handling I-129F petitions for K-3 visas.

VCS however is not some private organisation, so I question whether they can keep on doing this (since US Citizen living in eg. California would have the K-3 option while a US Citizen living in Pennsylvania wouldn't - not exactly correct policy).

And i'm amazed they actually admitted this over the phone (though over the phone you can of course say whatever you like. If it's on paper, whole other ballgame.)

Just my penny on the subject, but we haven't heard the last of this yet.

Yeap that may be the case, cause we have seen 2 petitions in the past 3 weeks where the I-130 was passed, and I-129F left in the Black hold of outer space. And that is it for approvals from VSC on family petitions.

But, but for them clearing out the back log, yeah sure, they need one hell of a shovel to do that, cause all VSC is processing is K1 filers!!!!!!!!!!!

Yes, I sound bitter, and I'em, the family petitions have been left to rot, and familys suffer due to this process.

VSC need to get their priorities straight, but we are dealing with the government, not gonna happen.

Right now, I'll take any approval for my husband.

I know, but other thoughts run thru my head, of how long to transfer, what order will they process in, and of course, the big of the biggest, will all parts of petition make it there??? Yeah I know, Im sooooooo positive. Keep fingers crossed this week.

I am not sure if there is merit behind the theory but it would not hurt to call.

Here are a couple of possible reasons for the delays:

Cases that take longer than an hour to complete are not provided additional resources in the office’s budget. Offices with more than the average numbers of difficult cases or offices that try to work the difficult cases thoroughly will not be adequately funded because the number of completions will be low. Meanwhile, offices that push to complete the easy cases will see their budgets grow. One field office visited by the Ombudsman has a large number of long-pending cases which require substantial adjudicator hours. However, officers at that office indicate that they cannot address the older, difficult cases without negatively affecting their productivity report to USCIS headquarters.

The Ombudsman has observed that newer cases are processed more quickly while cases more than six months old are increasingly backlogged. The Ombudsman supports the USCIS drive to maximize case completions, but attention needs to be directed at clearing older cases.

Seems like there are some motivation for the service centers to process the easier applications first since this affects their ratings/funding.

This is very critical for some, especially someone like me who DID not file a I130 for my wife's daughter trying to save some money upfront and get them both here (k3/K4). If i were to file for her I-130 NOW, there'd be a huge gap in time and i'd really be messed up.

One piece of advice to who does call and chew their a$$ out, be polite but strong, cause there is nothing worst then a government employee who holds your file "life" in their hands. Being a lunatic is not going to solve anything. I deal with DHS employees everyday, and sorry to say this, they are only following orders passed down to them. After believe it or not, they are human. Good luck everyone, for Im in the same boat as you are.
