I'm talking about the visa getting denied in the counsalate.

The petition gets sent back to the service center which gives you another shot at addressing the problem. If the SC denies, I believe you can still file again.

denied as in ours and got sent back? it comes back if to calif they let them expire if vermont they hold them forever with no review. Best thing is to get it held there andhope for second interview

Calif told me ours was NOT DENIED ha just EXPIRED but i did get a statement out of them we could refile so we married and did refile. Vermont has held some for 2 years and still never given the couple any type of response

I have done some thinking about this subject. We are a couple months behind your time line.

This is just me thinking, based on my circumstances.

The first thing I would do is contact my Senator. Why? Because: I have been to conferences with him and have had lunch with him a couple times. We're just acquaintances, but he knows who I am.

If that didn't help, I would go back to China and marry Li there. That would boost her spirits and I would consider applying for a K3.

It is more likely that I would just leave America. My position would allow me to find employment in any country where English is a primary language (and some where it isn't).

I know, everyone has different abilities and circumstances. Mine would allow me to move forward with my relationship with Li in the face of a flatly denied K1 visa.

Follow the process to reverse the decision as far as possible.

There are people here who have been through it and can offer very good advice.

Before the interviews always have your rep send a email/letter on your behalf to let the embassy know they are watching and waiting on the outcome. This has helped in many cases, then if you find it is to be returned again let them be the first to send again in question of whats going on.....best to get them held there....always

It largely depends on the reason for the denial.

There is a recent denial in the sub saharan forum for supposed misrespresentation because on a prior visitors visa request. The man involved used Steve instead of Stephen and mistyped his birth year by 3 years. ( I bet he was using the numberic part of a computer keyboard I see it all the time ) on the same visitors visa application . They are seeking legal help in fighting the denial. It can be a terrible thing they are going through. They are unable to live in his country for a number of factors that may help them get a hardship wavier.
