I have another K-2 viss question. My fiancee got her embassy interview letter today where both names, my fiancee's and her son's name, appear in this letter. Her interview day is set on May 15, but we agreed to delay her son's K-2 until February 2009. Question, does he has to accompany her to the interview even though we are only requesting the K-1 visa at this point in time?

As a background info here, we have not submitted any paper to the embassy indicatiing that we want the embassy to issue the K-2 visa at this time. We didn't fill out the forms for him nor he is getting the medical exam or fulfilling any other requirements for his visa as we are being doing for his mom.

it is a very specific situation

my advice would be to call the embassy and find out.

If you can not contact them it would be better for your fiancee's son to go too.

Even if they issue him a visa, he does not have to use it :)

I don't want the embassy to issue a visa for him at this point in time, and as we understand the process, we have one year from issuance date of the K-1 visa to request that the K-2 visa process should start. Actually, it is a little less than one year, for the K-2 visa must be issued before the year is up.

I would email the Consulate to inform them the son will follow to join and ask for any instructions they may have for that procedure. They won't issue a visa unless he gets a medical and shows up with a passport but his option to follow to join will remain regardless. You just want to know their recommended procedure.

Thanks for your advice. I just did that yesterday by sending an e-mail to the embassy and requesting any corrections in my assumptions about the K-2 visa. The boy will not be present at her mom's interview, but I explained to my fiancée, the boy's mother, that she needs to talk to the consul so that the case will be in stand-by for the K-2 visa for her son, for he only has one shot at getting into the US since he is already 18, and he will be 19 by the time he joins us some time next year.

I am just praying that everything goes well, for I don't know if the original petition, the K-1 was intended for a K-2. The boy's name appears in the I-129F, and in all the correspondence sent to my fiancée by the US embassy in Bogotá. I hope the embassy pays attention to my e-mail, for the interview is just around the corner on May 15, 2008. I do hope that the consul explains well everything and he gives considerations to whatever my fiancée has to say on her son's behave. Of course, all of these things are pending actual approval of the K-1 visa.

The embassy finally answered but I got just a generic answer telling me more or less to be ready for the interview. My fiancée is ready, but we are not planning to take her son to the interview, for we did not submit any paper work for him. I told her to be prepare to explain her case and that we know about the option to have the K-2 visa to be issued at a later time, but before the issuance date of the K-1.

Any suggestions will be appreciate. I did send another e-mail to the embassy, but I think the K-2 is now in the hands of my fiancée at the time of her interview on May 15 2008.
