Hello to all from a new guy. My girl (Ukraine) and I have finally decided to take the big step and despite a years worth of research

find myself with more questions than answers. I know we must have permission from her ex for her daughter to move but is this

permission required with the original application or when she goes for the interview? And just out of curiosity what actually happens

during the 6-9 month K-1 process? Is someone at the service center diligently verifying information or is the package merely waiting

it's turn in line?

you should doublecheck by calling to USCIS but as I know you'll need permission when you'll be taking the child out of country

but call USCIS to talk to them

Service Center : Vermont Service Center

Consulate : Ukraine

I-130 Sent : 2006-12-11

2008-05-16 CR-1 visa issued

2008-05-20 recieved visa

2008-05-31 I arrived at JFK (took me 1hour and a half to be out of the airport with a stamp in my passport)

10 year GC

2010-03-06 I-751 sent

2010-03-09 NOA-1

2010-03-10 check cashed

2010-4-12 Bio (done early 3-29)

2010-6-3 card production ordered

2010-6-19 10 year GC recieved

N-400

2011-3-28 application sent via express mail to LEWISVILLE TX SC

You don't need it to send the petition, but yes you will need legal paperwork about the father agreement for the interview.

What i did in France :

My ex and I we hired a lawyer together. The lawyer wrote our agreement and send it to what we call in France the Family Judge. I wait for the court appointment now, it will be at may 5.

The judge will read the agreement in front of us, will asking if we both agreed and we will have to sign it.

So, it mean that i will go to the interview with a judge decision, which is the best.

Where are you from in Texas, and what is your Ladies city?

That is certainly optimistic and might only be to clear the USCIS... you then have NVC and the consulate process adding another 2-3 months if you are lucky....

Thanks to all for the quick answers, I hope to have all documents in place and petition filed within the next 30 days, my insane job not withstanding! And to my fellow Texan I am originally from West Texas but have lived in the small burg of Crosby, just a bit east of Houston for the past 14 years. My lady is from Uzhgorod, an ancient beautiful city on the Hungarian border. I just returned yesterday from my 4th visit in 9 months. Again thanks to all.

there is a difference between sole custody and removing all legal rights of the ex. Very very rarely do courts remove legal rights of a parent. The child has a right to see both his parents. And both parents have rights to see their child.

I think the first thing you need to do is ask the childs parent if he would allow it. If not, then you go to court and see if they can force it.

01-10-2008 : Case forwarded to New Delhi Embassy by NVC.

01-14-2008 : New Delhi Embassy received our file from NVC.

01-24-2008 : Submitted Packet 3 at New Delhi Embassy.

02-06-2008 : Submitted docs at VFS.

02-21-2008 : Interview- visa was approved pending security.

02-25-2008 : Called NVC and they said Visa is approved. VFS- they didnt get it yet.

02-27-2008: Visa in HAND!!!!

03-08-2007: Arrived at POE(JFK)

May 12-2008- Got the Marriage License

May 19-2008- Married!!!

This is right off the US Embassy Website in Kiev:

Your fiancé(e) will be asked to present:

Valid passports or travel documents for the beneficiary and any dependent children

A notarized statement from an absent parent giving permission to a child to immigrate to the US along with a photocopy of the photo and signature pages of his/her passport OR court decree of sole legal custody OR death certificate

Actually in countries like the Ukraine it is not as rare as you suppose - marital and child abandonment, lack of support, non-communication over a period of years can all result in the parent who takes care of the child sueing and receiving the decree of sole custody. Legal right and moral right being two seperate things.
