Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage

Fantastic website and a wealth of information...thanks to all for your contributions. I have a quick question that the search engine can't seem to resolve. Once I submit my Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage to the registar's office in the city of my fiance (Bacolod City), it is written that there is a 10-day waiting period before a license is issued. Does this mean I have to return to the registar's office to pick UP the marriage license or will they mail it to her address? I'd much rather pick up because I will only be in the country for 21 days and I'm nervous that I won't get the license in time to actually have our ceremony.

We're trying to make contingency plans to have the ceremony there in case her B2 is denied. She does not have property ownership (though she pays all the bills for her family including rent, utility, etc) but does have one small child (two-year-old). I would like to think a 20-day visit to the US while leaving a child behind proves strong ties to return to the island but who knows? I want her to come here for a visit but NOT to marry. We'll do that with either a K1 (here) or K3 (marry there).

Any comments on either case above? Thanks everyone!

There is a 10 working day waiting period to pick up your marriage certificate to become legally married. The Embassy does the Affidavits from 8 AM to 10 AM in the morning. I then went to the Local Civil Registry to file for the MC. It is required to take a family planning seminar. We picked up our MC the day before our wedding.

Even if your significant other is granted a visitor visa, it is still possible to be turned away at the Point of Entry at the US Airport. The final decisions are up to the consular interviewing for visa and agent at POE.

Naturalization

3/23/14 - N400 package sent to Phoenix

3/27/14 - N400 package delivered

4/3/14 - NOA1 receipt date

4/4/14 - check cashed

04/29/14 - biometrics date

07/01/14 - interview date

xx/xx/xx - Oath Ceremony

I don't remember Local Civil Registry delivering Marriage License.. So YES the only way to get it is to pick it up..

You know since The whole country is corrupt.. You can get that marriage license the same day.. (Money Talks) :D You can even skip the marriage counseling.. (For the Price) :D

Having a child in the Philippines and leaving them behind does not give you a reason to have strong ties to the country.. Heck alot of parents abandoned their kids for a new life abroad..

Strong ties meaning.. A high Paying Job, Numerous Properties and businesses, etc..

Isn't this a requirement for a church ceremony only? Thanks for the help and info!

That's another seminar from the church.. If you guys are planning to have a church wedding in the Philippines..

But the family planning seminar is a requirement to obtain a marriage license..

But like I said money can bypass all that.. Won't even cost you much..

We were gonna.. But the mayor was out of town and no one will sign for it.. So We ended up getting it 3 days after we applied..

My father in law knew the mayor in my wife's town..

Roserick please don't generalize. Not all government office is corrupt. I'm offended because I used to work in the government also and we were not corrupt. The judge that granted my annulment was not corrupt because my daughter and I have to go through a lot just to get what we have right now.

I'm only going to be there about three weeks. We've discussed it ad naseum...the possibility of her not getting a B2. We originally wanted her to come here for visit BEFORE we marry but it appears with all that I've read, getting a B2 might be terribly difficult for someone who owns no property or is not a business owner...even if her visit is only for three weeks and does not include marriage plans. That is why we felt marriage in Philippines was probably going to be the most logical route, followed by K3 process. However, I don't want to cut it so close that our civil ceremony literally is on the tarmac while my plane is taxing on the runway en route back to Manila and the states. I could of chosen to pursue a Filipina with a college degree or business owner with more ties to her country than one could shake a stick at but I fell in love with a girl who supports her entire family (father is deceased) by working at a fish market and truth be told, I wouldn't change one thing. I can hear this woman's footsteps from the other side of the world, that's how much I love my girl. It's going to make it more difficult for us to be together based on the sparsity of her ownings but given enough time, even the most stubborn mulberry leaf turns to silk.

I just want to add that the whole country is not corrupt. The only corrupt family that is widely known in the country is The Macapagal-Arroyo family. Please don't go spreading words that you really have no knowledge about.
