AFFIDAVIT OF DISCREFANCY

Hi Guys,i want to ask if i really need to get an AFFIDAVIT OF DISCREFANCY for my son so that he can travel w/o permission from his father...i am not married with his father and he abandoned us sinced 2004...on his BC his father's name is there but we are not married...so do i still need to get that affidavit?

please help me coz i am starting getting his papers b4 i leave to USA..we will file a petition for him to follow me to USA and i want everything ready b4 i go...

Nov. 23, 2009 mailed the I-751- Lifting of Conditions

Nov. 30,2009 USCIS sent it back to me coz i sent it 1 day earlier

Dec. 05, 2009 mail it again

Dec. 15, 2009 NOA1 recieved - GC 1 year extension

Dec. 24, 2009 recieved Biometrics Appointment

Jan. 08, 2010 Biometrics

Jan. 27, 2010 Approved...my card will be here within 60days

Feb. 01, 2010 Recieved 10 yrs. GC in the mail

March 17, 2008 papers for son sent to chicago

March 19, 2008 chicago recieved the papers

March 27,2008 NOA1

June 03,2008 NOA2 Petition Approved

July 19, 2008 AOS fee bill send to me...with MNL case number.

Aug. 14 2008 notice for visa payment

Aug. 16, 2008 I-864 download instructions

Sept 4, 2008 DS-230 instruction recieved

Sept. 29, 2008 NVC asking for missing documents for my son

Oct.18,2008 mail the letter of consent from the father

Oct 20, 2008 NVC recieved the letter of consent

Nov. 4,2008 recieved letter from NVC with the date of interview

Dec.09,2008 Medical at St. Lukes

Dec 22,2008 Interview for my son at Manila embassy

Jan.7,2009 Submit the proof of relationship

Feb. 02, 2009 going home to Phils

Feb.20,2009 Fly to USA...Mnl-Detroit

Sept.1 2009 Embassy sent a re medical form (almost 9 months waiting)

Nov. 9, 2009 Son re medical at St. Lukes...passed!

Dec. 08, 2009 VISA issued...thanks God!

April 25, 2010 son flying to USA---nxt journey,CITIZENSHIP!

What exactly is an AFFIDAVIT OF DISCREFANCY? Do you mean DISCREPANCY? But that word does not make sense in this context? I'm curious, as I've never heard of such an affidavit.

The OP is not going to travel w/ her son....they are pursuing a "follow to join" scenario. I don't know where you would get such an affidavit...but perhaps the US embassy in the Phillipines may be able to help you.

The OP is not going to travel w/ her son....they are pursuing a "follow to join" scenario. I don't know where you would get such an affidavit...but perhaps the US embassy in the Phillipines may be able to help you.

if you were not married to the father, you have sole and full custody of your child.

its not something US embassy Manila can do or help her with that, its something to do with the Philippine immigration

Where do you see that? She stated that she will file a petition for him to follow her to the US....I understood that to mean that she will arrive her and her son will follow at a later date, presumably alone. That's why she thought she needed said affidavit.

Where do you see that? She stated that she will file a petition for him to follow her to the US....I understood that to mean that she will arrive her and her son will follow at a later date, presumably alone. That's why she thought she needed said affidavit.

she hasn't stated whether she will return to the Philippines to bring the son here or if the son will travel here alone or someone other than her. that's where a DSWD Travel Clearance would come into play.

I think her concern is whether she needs permission from the father to bring her son here. since she has full custody, I do not believe so. someone correct me if I'm wrong on that issue.

Well by reading the link posted earlier by another member, I don't think she needs permission from the father either....but then, from what I glimpse on some of the posts, sometimes things are a bit "hinky" in the PI. (Like having to wait a horribly long time to get an annulment in a situation when one spouse clearly abandoned the marriage a long time ago. But as there's no divorce, I understand the need for this avenue....I just don't understand why it takes such a long time.)

Perhaps someone who has done this, had their child emigrate from the PI without stated permission of the long absent father, will happen upon this thread and offer their take. :)

In our situation, the biological father disappeared before our daughter was born. my wife was never married to the father. he was not listed on our daughter's birth certificate.

not one question was asked about the biological father during the entire process in our case.

In our situation, the biological father disappeared before our daughter was born. my wife was never married to the father. he was not listed on our daughter's birth certificate.

not one question was asked about the biological father during the entire process in our case.

Ah, but in the case of the OP, the father's name is listed on the BC, so it may come up. :unsure:

Since the OP is a single mother, under the Philippine laws, she has sole custody of the child hence no need for an affidavit of consent from the biological father to travel outside the philippines even if his name is on the BC of the child.

Removal of Conditions :

August 16, 2010 - Petition received by USCIS Vermont Center

August 20, 2010 - NOA1 received

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.
