So I'm the mom and doing leg work for the "kids" son meets beautiful Bulgarian woman this summer while home on leave and she is in the States working with Student Work Visa, son proposed from an undisclosed deployment location Christmas Day....beautiful girl had already gone to the Bulgarian Embassy for Visitor Visa. Could they get married in the States next month while she visits? What should she do? Has meeting with Bulgarian Embassy Jan 22....thanks for the guidance!

She can get married, but can't stay, and would have to return to Bulgaria and apply for a K-3 or CR-1 visa. If she stays, since they're already talking about getting married, they may have a hard time proving there was no intent to stay and adjust status, which could cause a lot of problems, mainly, visa fraud which is a deportable offense.

I'm a little confused. The OP says "she's here..." but that she's gone to the Bulgarian Embassy for a visa. If she's here, she doesn't need another visa now and she wouldn't get it from the Bulgarian Embassy. So, let's back up and get the facts. Where is this girl now, and if in the US, just what kind of visa is it? If she's still here on a student visa that allows her to work, then as long as she doesn't overstay, they can simply marry here and file to adjust her status to permanent resident. On the other hand, if she's gone home to Bulgaria, any new visa would be obtained at a US Consulate in Bulgaria, not a Bulgarian Embassy.

So, Mom, what's the scoop?

Thanks for the quick reply! What is the second type of visa that you mentioned? Just to clarify..they don't want to do anything illegal, so it's OK for them to marry and then adjust status when she returns to finish school, and he is service obligations? Any other tips you'd care to share? Thank-you so much.

Ok, so she "was" here and is gone. No, since they are already engaged, coming on a student visa with the intention to immigrate through adjusting status would be visa fraud. Check the guides for fiance and spouse visas. If they want to marry while she's in the US, then the CR1 visa would be the best bet.

OK, The "girl" lol :blush: is in Bulgaria, she is planning to return to the US for a visit while our son is home on leave, he is presently on a ship returning to the country....the leave time is scheduled for sometime the end of FEB and the "girl" wishes to travel back to the US to stay with our family....she would like to finish her degree, and he has some time comittments left to the Corp. BUT they would like to marry and then proceed to finalize things in the appropriate manner...please excuse me for not applying the appropriate terms embassy yadeeya .Thanks for your help we appreciate it very much.

more elobaration please, i guess she came on a student visa, then she went to bulgaria for visit when her student visa still valid, once she had her valid visa to return to usa she can get married to him and adjust status she does not need to go back and wait for CR1 or K3. then back to Q that she does not need visa to go to bulgaria she could need one some student visa will not allow u re-entry so if u want to visit ur home country during ur study u need visa. talking from canada student visa experience dont know about usa tho.

No, no! They are already engaged, so what you are suggesting is visa fraud. It would work if they got engaged while she was already here.

Excused you are. The point is that the advice you get can only be as good as the information you give. Your big error that confused me is that you wrote "is here" instead of "was here".

How long is his leave? When he arrives home, will he already have orders to deploy again?

When does he get home? When does she next arrive?

All this makes a difference for your options.

Hey I certainly appreciate your generousreplies....it's a bit daunting to try to find simple answers to complicated questions out on the world wide web...so the CR-1 is what they should do? Officially speaking they met,he proposed last week, in the meantime she had gone to apply for another visitor visa . She had no idea he would officially ask her to marry.....

Yes, based on what you say, I think that's the best plan. There's a hitch though. I'm not sure if she has the visa now or what kind it will be but the visa is only the first hurdle. Being admitted at the Port of Entry, POE, is an entirely different issue. If she shows up and is asked, "What is the purpose of your visit?" and answers, "I'm coming to marry my American fiance." she's probably going to find herself taking the next flight home without ever seeing your son. She need not answer that way, of course. Marriage is not the only thing she has planned, even if it's the primary reason for the visit. Will she also be enrolled in and planning to attend school? If so, that is the purpose of her entry. If not, perhaps she will be visiting friends and family too, since her fiance only has 25 days leave. I'm not suggesting she lie at the port of entry by any means but they don't need a full itinerary. School, vacation, visiting friends, pleasure or simply "business" when that's the case are perfectly acceptable answers that are generally complete enough. I usually confine my answers to "business" or "pleasure" when entering a country.

She can stay until her I-94 expires or until it's time to return to Bulgaria to get the medical and attend the interview, whichever comes first. When she returns with a CR1 visa, she'll have conditional permanent residency. 21 months later she can apply to have the conditions removed and obtain full LPR status.

I suggest the three of you study the appropriate guide for CR1 by clicking on the word "Guides" at the top of any page here, then study the instructions for the I-130 petition to get an idea what will be required.
