Basically there is no way.

You need to just file for the new visa asap.

Ok , 6I will find out more tomorrow and thanks for all your help i really appreciate it. So i will need my wife to file the i-130. This costs $190 and in 6 months when im accepted i am a permanent resident? Can i work right away. Im lucky i can get my old job back made a cal today. So like despair said i will have to make the most of it and im sure this will make both of us stronger. I can live here with my mum and i can visit sometime in Feb to break the time up a little. It said 6 months on the prossesing times page. I will write a letter with it explaining my situation. Just incase i get a good guy dealing with it.

So to recap Lisa fills in the i-190 and we both fill in the G-325A. And i will recieve permanent residence and work permit?? or does green card give me that right. I wanna get all these forms ready just to be saef and get it done quick.

If you go the K3 road you will have to file for AOS once you come back to the US (just like with the K1).

CR1/IR1 is the one where you get the I-551 stamp in your passport at the POE (which allows you to work right away) and the GC in the mail a couple of weeks later. You will be a permanent resident then.

Take the time and check the guides out on VJ to decide which of the two is the better one for you.

If you go the K3 road you will have to file for AOS once you come back to the US (just like with the K1).

CR1/IR1 is the one where you get the I-551 stamp in your passport at the POE (which allows you to work right away) and the GC in the mail a couple of weeks later. You will be a permanent resident then.

Ok i think the CR1/IR1 is the one for me. I want to work when i get there and not need to wait another 90 days. Its a shame my $1010 has gone down the toilet. Where can i find tis form and whats the cost?

With CR1 you will not have to file for AOS when you come to the US. You will be able to work and be a (conditional) permanent resident. If you have been married for less than 2 years when you enter the US on the CR1 then yes, you will have conditional resident status and will have to apply for removal of conditions 90 days before the 2 year mark.

Banish the thought of those 1,010.00 you spent... I know it sucks and it hurts, but you will get through this.

The CR-1 process is begun by filing the I-130 at the US service center. The cost has recently gone up to file.

As far as your other questions, no, you do not need to adjust status after you enter the US on a CR-1. The reason the length of your marriage is important is that people married less than two years receive a CR-1 (and a two year green card upon entry) and people married more than two years get the iR-1 (and a ten year green card upon entry).

The I-130 now costs $355 to file.

Go ahead and write the letter, but that really isn't going to allow you to circumvent normal processing times, so I'd prepare myself to wait the 6 months if I were you (at least).

Your wife files I-130 to USCIS in the USA, fee is $355, if you are married more than 2 years when the visa is issued or before entry to the USA you will automaticaly receive 10 year un-conditional green-card.

No status to adjust from on a CR-1/IR-1 visa, only if married less than 2 years upon entry will you need to file to lift conditions 2 years later.

The loophole that the imi attorney may be banking on is sometimes, if still within the 90 day entry window, a K-1 can be revalidated for a second entry... this assumes the marriage to the USC has not occured...

I'd assume since the marriage has occurred in this case and the OP entered back in July, that would pretty much be out then?

(Not being snarky, honestly wondering.)

Of course since both marriage has occured and 90 days has elapsed... my point only was that this might have been the glimmer the attorney was thinking about and simply needs to gather more facts....

Regardless, his onetime only entry visa was already activated at the POE when he originally entered the US. They don't restart the clock if you do not get married within the 90 days if you leave and re-enter the country.

It's a moot point anyway, as he already has said that they are married. What were are left with, is sadly an unfortunate situation.

Regardless you have to file the I130. The K3 is for someone who already filed a

I130 who want to enter the US while the I130 is being approved. The CR1 route is the cheaper, less hassel and you will be able to work once you arrivein the US as everyone stated. Good luck!
