Working Before Green Card Arrives

I live in the UK and work for a Global company. There's a possibility that my company will allow me to work remotely from the US after my K1 visa is approved.

Am I legally allowed to continue working for this company, remotely from the US, before my AOS comes through or should I plan to quit my job prior to the flight out? Do I have to be unemployed until my AOS goes through?

Thanks in advance for the advice. I don't want to get in to trouble for working without the correct legalities in place.

working remote is fine if the pay is deposited into your uk account.

IRS aside you are work authorised as a K1, you do not have evidence, EAD, but you do not need evidence.

Tax etc issue, not an immigration issue.

Getting paid in the UK is not what makes it legal.

There are a few factors to consider.

Is the work US related? Is it truly work related to the position in the UK?

If you are working from home on stuff in the UK, then you are probably fine. You are not taking an American job.

If you are working out of a US office while being paid in the UK, then you and the employer would be unlawfully working in the US and avoiding US employment and income taxes. You could be deemed to have taken an American job.

Hopes that helps. Evaluate whether you might be taking a job that an American can work.

I will have the exact same job and just be working from the US. I would not be taking an american job.
