I-797, Notice of Action-validation date

Hello everyone,

Maybe someone knows the answer to my question-

We received "I-797,Notice of Action", which states :

Notice Type : Approval Notice

Valid from 10/18/2012 to 02/17/2013

Does this mean, I have to have my Interview Appointment before 02/17/2013? What does this valid date mean?

I´m very concerned since the Consulate didn´t even send us the appointment letter for the interview yet.(in Germany we can´t set an interview appoinment ourself)

I had the same concern when our interview seemed miles away. I contacted the consulate in Guangzhou and they said that if they couldn't schedule the appointment before the expiration of NOA-2 they would still honor it. Now if they do schedule the appointment before the expiration date and have no contact from the beneficiary and the notice expires you go back to the beginning.

Thank you very much for your answer! i tried calling them a couple of times already-without being successful though. So I emailed them today asking,if all of our documents are complete and if we can expect them sending us the appointment letter soon. Our attorney and I stay in contact with the Consulate at least 3 times a week. do you think that´s enough?

The 797 form is used for many purposes. For the K-1 the expiration date on it is meaningless. Don't even worry about that.

Call DOS (202) 663-1225, I think you press 1 then 0 to get a human. Ask for a visa specialist and ask them the status of your petition at the consulate. They should be able to tell you if it has been received and if it's been scheduled for an appointment. Have you gotten your case number from NVC? You'll need to give that to DOS so they can pull up your case file. Also go to the Germany portal and look around.

So you didn't even receive the letter from Frankfurt telling you that they received your case and that you may submit the visa application forms and all the supporting documents (Pack 3)? For us it took about 3 weeks from NOA2 to Pack 3. Are you sure you submitted all documents they asked for? The Frankfurt consulate will only schedule your interview one they have received ALL documents on the K-1 checklist.

01-18-2013 - Visa received by DHL

Thank you so much for that information! My fiancé called that number and was actually able to receive more information about our case than by calling in Frankfurt.

We actually received the letter that told us that our case was received in Frankfurt and also further steps. Since we hired an attorney to handle our case I had to find out that the package 3 he mailed out was missing important documents. So I submitted them and now we´re still waiting on my interview appointment.

Those dates are meaningless....in the K-1 process. Do not even worry about that. Once NVC and then the Embassy have your case, they control everything, including the dates. Again, don't worry about that, the 797 form is used for different visas and items where those date are more applicable.
