Comments : contiuned for medical update to within 60 days unless IO actually looks into what I said that K visas didn't require the medical within 60 days of interview. Was told he never heard of this and would investigate it and let us know in a week. I almost bet there will be a RFE for the unneeded
medical. RFE received for missing medical from a panel physician according to actual letter. Sealed packets delivered to POE. Had to retake the medical even though we saw the documents in the packet when the officer was looking for them. Stated they were expired so didn't understand their policy for the K visas and required us to spend more money to have medicals done again. Don't know why the vaccination reports would change in a short amount of time that was completed in her home country. Still less than one year from issue before filed for AOS. Retaking the medical and waiting for the RFE and adding the medical and wait times for return of Labs added another 20 more days of waiting and a additional $1200 for medicals for spouse and 2 kids. 236 days from I-485 received date to approval date.

Embassy Review : Officer was very nice, not very knowledgeable with regards to K type visa and medical requirements USCIS Policies. Would help one to have the copy of policy manual pertaining to the requirements to the medical issue of having another done within the 60 day window prior to interview. Policy is very clear to read but not every officer will take the time to read it or look to see if what they are stating is incorrect. Ours didn't do this and sent a RFE stating that the medical was not completed by the panel physician in her home country. Which we all know that this isn't possible in order to get the K1 visa in the first place. There is no way to just skip the medical and still get this visa. Even though we actually saw the medical documents in our file in his hands. He was reading from them the expiration date from them. Then states we don't have it in a RFE. We knew that when he told us he would look into what we were stating that he wouldn't actually look and make the right decision. Easier just to RFE it and move on to the next case and make us wait and spend more cash to jump through another hoop.
