Ben&Zian got a reaction from AKN2 in My Boyfriend is being Deported
This "legal technicality" or what have you of "he wasn't informed when he pled guilty about possible deportation" is always a desperation move. Of course people know when they commit a serious crime/felony they are subject to removal. They aren't citizens. If they think otherwise, they really didn't even understand the terms of their permanent residency. It can't always be other people's responsibility to remind/inform people of this. People need to be adults and actually understand what they are doing. Legally he should be apprehended by ICE the day of his release and held until deportation occurs. Sorry, can sound really harsh or mean; but that's just how it should work.

Why people are so 'desperate' to immediately go home and travel after just having dealt with the long wait to get here in the first place is beyond me; but regardless, if you have AP, then you're fine. That's what it's for, travel and re-entry. As noted, immigrations has final say on entry, always has been that way. It isn't because of the "current climate", i laugh about that all the time. Again it's been this way for years and years. So either take the "chance" or "risk" to travel, or just wait until you have your green card. Pretty simple stuff.

While some here are giving you advice and all, let me say from personal experience. Served 6 years, active duty Army, 3 deployments, 2 OIF's and one OEF for half of my six years enlisted. I never completed any degree plan or anything, did not have the luxury of some in the military to go to school during my service, but when I got out went through a job placement agency for former military and I have since day one with this company, for some 7 1/2 years almost, made more than most with a 4 year degree. I work and travel internationally (am in Argentina right now in fact); but I am starting schooling again next month online for a BA then hopefully Masters as long as my GI lasts then just finance it myself.

So when people ask "What's your education like"? Don't think you're doomed or have to settle for less. Experience and all matters a lot to some companies. I had several turn me down for saying "I can read and instruction manual 100 times; but I will learn more in 1 hour hands on" some like it, some don't...
    Just keep looking and trying.

Exactly. Even permanent residents who commit crimes/felonies have hard time adjusting after that, and even face deportations.. for the OP it's almost worse since she never was even legally in the country to begin with, and now has two deportations... how many times does it take for people to either learn, or for the US to finally put it's foot down in the sense of banning people without the possibility of waivers/forgiveness.

Then all this travel is your choices to make.  Point is don't blame other things for your own choices. As someone who spent 12-15 months on deployments in the middle east, trust me, it's not hard to stay away from family/friends/ect. Honeymoon can be done at anniversary and some don't even bother with it. That's again, your own personal choice to make. And the ability to travel must also show you got EAD but don't want to or aren't working cause I know a lot of companies wouldn't be giving any time off within first 6 plus months, that's usually just an evaluation period. Point is, again, if you're "worried" or "afraid", don't go regardless of whatever circumstance you wish to use as the reason, just pretty simple. And as for the GC holders being held up before, yes there was some miswording/guidance in the first "ban", but also again only USC's are guaranteed entry into the US. A GC still doesn't; but that issue has been corrected and the ban also was supported by the SCOTUS yesterday in it's entirety. So if the laws of this country worry/bother people, again, it is all your personal choice, and a lot of immigrants(regardless how they came in legally through marriage, K-1, F1, ect) understand this and applaud it all (my husband does).. So that's all I'm saying.

Just always be honest when asked questions. Think if you answer "No" to prior use and then they find out you have. Way worse than just being upfront about it to begin with.

Like above. The statement of how we met can be a brief, 1-2 sentences or an attachment if you wish to explain more.
The letters of intent to marry are simple statements from each party stating they intend to marry within the 90 days if approved for a K-1 visa, and then signed. This can be scanned by the beneficiary and emailed to you the petitioner to print off.

I myself never have heard of an RFE because of not attaching FaceBook TOS.

There's a good amount of people here that seem to have met through FB someway or another.

Generally, RFE's are sent out because the person reviewing the petition is unfamiliar with the website or dating site that people had met on.

Commong sense for most is that FB is in no way associated or thought of as a marriage broker at all.

Each of you are supplying a letter of intent to marry correct? Both say the same thing just reverse the names essentially. Can be signed and scanned by the beneficiary.

As for meeting, main things are passport stamps showing entry/exit of their country(or 3rd party country if that is the case), receipts, hotel receipt, any credit card statement from purchases, flight tickets/itenerary, ect.

Ben&Zian got a reaction from B_J in Beware bad information on AOS deadline for K1 (fresh out of jail)
Maybe should add into the K-1 visa guide/flow chart at the very beginning in big, bold letters "Have all money necessary for the entire process to include AOS before you even bother filling any paperwork out!".  Since always seems to a thread or two about financial issues being a reason for not AOS'ing. This OP has a different scenario so could be "Arrive in the US, marry relatively quickly, apply for AOS immediately, don't wait until day 90!"

Well minus the obvious issue and dilemma it caused you, it's nice to hear police and border patrol working together for once. Hope you get your issue resolved quickly.
But will say, it isn't so much bad advice online or lack there of, when you enter the US on the K-1, the visa is voided and you are legally present wth the I-94, when it expires, so does your legal status, somewhat common sense.
And while obviously jail time and bond money is a huge ordeal, for myself it's good they are taking things more seriously than just "catch and release"....

Ours went straight to "Issued"; but a lot of people have said that going to "ready" means "issued is next. It is almost random.
Did they say approved at the interview? Keep your passport?

Total fee is $1225, you can combine them on one check for payment.

The AP (I-131), apply for it. We didn't intend to use it, didn't put any possible travel dates, just left it all blank almost and they approved it no question.

Ben&Zian got a reaction from HKS in School Paper - Should illegal immigrants (documented and undocumented) be given pathway to US Citizenship?
Some conclude that when illegal aliens, who work, illegally mind you, if they pay taxes they should be given a right under the "no taxation without representation", but that's just gaming the system honestly. Mean come on, here illegally, then working illegally, but wanting "fairness" and representation. I agree with @Roel , and a lot of us on here will honestly, they should be no pathway at all. Even through marriage or employment, there needs to be some penalty. I would even go as far to say for visa over stays, leniency and waivers just make it like it never happened when there should be consequences for their choices.

Yes, she must supply an I-134 and all financial documentation also.

Even if you are using a co-sponsor, she, your fiance, will always be the primary sponsor regardless.

No, the petitioner just needs to make a real basic explanation on how and when they met. Literally can be one or two lines or you can put "See attachment # .. " and use a separate page if desired.

It was an alleged policy like 3 years ago because of possible 'natural disasters' but don't know if that really pushed any of them to the front of the line (could be close ties to the US also, but doubt it) but don't think anything like that is in affect. Also had heard it actually was just fully in place because of the potential for storms and such but again, doubt it really.
