  1. My parents jut got the interview letter for January 2024. What are the next steps to do? I am a little overwhelmed at the moment since I expected the interview only by March/ April.

  3. Both parents got approved today. Waiting to hear the good news for others. 2021 Filled I-130 for parents: November 7 Cases Received: November 8 Dad I-130 being reviewed: November 10 Mom I-130 being reviewed: January 25 2022 Approval: September 15
  4. Did you get approval on Aug 30, 2022? I just got an email today stating that they have taken action on my case and when I check the Case history on the USCIS page, it says 'Case Is Being Actively Reviewed By USCIS' on September 13, 2022. Not sure if its just a casual update or if I will see an approval or something else in the coming days.
  5. Just an update to this case. She never got an interview till date due to the delay in USCIS. She got an extension for another year. She travelled to Canada without any issue. My new query in regards to this case is; Since she has an additional year extension to her GC, can she apply for an I130 for her Canadian husband?

Cases Received: November 8 Dad I-130 being reviewed: November 10 Mom I-130 being reviewed: January 25 Service Center: Nebraska As of January 26, Nebraska Service Center is accepting case inquiry for receipt date of June 30, 2021.
  7. I don't think it will be an issue since she has travelled multiple times in the past and haven't over stayed her visit. Also having a return ticket will help. It looks like we have similar times lines from naturalization to filing the I-130 for parents and also having plans to bring parents for a visit before the I-130 approval.
  8. Thank you. You can check the updates on the USCIS website. I also have the USCIS app on my phone where I can check the case status. If the status says 'Case Was Received And A Receipt Notice Was Sent' means that it has not been reviewed yet. The status ' Case Is Being Actively Reviewed By USCIS' shows that its currently being reviewed by them.

  10. Ok thank you for that info. I didn't know it. I have seen cases where people did exactly this and then applied for file I-131, Advance Parole to extend their B1/B2 visa stay till the AOS was approved.
  11. I want to apply for Green Cards for my mom and dad. They are currently out of the country and have valid B1/B2 visitors visa. I have 2 options: Apply i130 in the home country and wait the process out (could take around 18-24 months) They come to US on the visitors visa and I apply for i130 and i485. Some of my queries are: Will they get an extension to stay on their B1/B2 visa if I take the second route? Can they travel back to home country if there was an emergency before the GC interview?
  12. I think it was an out of the ordinary scenario. Her final final divorce papers were received in December 2019 and she immediately applied for ROC. The interviewer and supervisor for the SB-1 at the consulate were handed all the proof showing how she was being harassed all the while even in her home country by the ex-husband and his family. And thus proved that she was not in a state to apply for ROC till she got the final divorce papers.
  13. Thank you for the info. She has a i551 stamped for 1 year. Would that suffice for the travel or does she need any other stamp in order to go out of the country? Yes that is what we were thinking too. She had her proof of marital issues including conversations and photos send to the USCIS which says it all regarding the first marriage. I believe she has to stay by those when she is interviewed for the ROC.
  14. This is the timeline of my friend. Married in 2015. Entered US in July 2016 via CR1 visa. Separated in December 2016. Exited US in December 2016. Conditional GC expired on July 2018. Final divorce decree in June 2019. Applied for ROC on December 2019. Remarried on April 2021. Applied for SB-1 on April 2021. Approved for SB-1 on July 2021. Re-entered US (1 year conditional GC) on August 2021. The USCIS status is 'scheduled for interview'. The few questions are: Her current husband is Canadian. Can she travel to Canada while waiting for the interview? Will there be any issue at the immigrations? What type of interview questions can she expect at the ROC interview since her first marriage ended in a divorce? Should she contact USCIS to expediate the case since its been almost 21 months? Should she chance her status to 'being married' in her ROC? Thank you in advance.
