Been in States since 2003 (J-1 visa), got married to my wife in 2005 (she was LPR at the moment), had asylum case going on. 2007 - lost asylum and received voluntary departure. Did not leave on time (was not possible). Wife received citizenship in 2008, I applied for adjustment of status, went to interview in 2009 and ICE took me right from the interviewer's office and deported 3 month later for overstaying visa and voluntary departure window.
2012 - filed I-601 and I-212 to avert effects of deportation, attorney did not know that I should apply for visa first. Got RFE requesting visa rejection letter from visa interview. Filed I-824 to get my approved I-130 transferred to NVC, it took them 11 month. On 10/30/2014 I-130 was sent to NVC, don't know if they received it yet. I have 3 month left on my RFE to get to embassy visa interview. If I will be late - another year waiting for I-601 and 212 processing, which is hard to get approved.
