How do I add a derivative family member

 Share

Hello! Our case is currently at the NVC. We just paid the fees and these have cleared. In the FAQs it says you can add a derivative family member to our case. I would like to add my daughter. However, the link to add her to the case is supposedly under my name on the summary page and it isn't. Does anyone know how I can add her? And also how long it takes to add to the case?

Thank you

Is it a spousal visa? There is no derivatives for immediate relative petitions. If your daughter was under 18 when you married your USC spouse (and she's still under 21) then your spouse can file a separate I-130 for her. (I am assuming that your daughter is from a previous relationship. If she's your USC's spouse's biological child then she doesn't need a visa, she's a US citizen.)

Yes it is. Yes, my daughter is from a previous relationship and she is under 18.

If I file it now, I will have to wait for hers to catch up? Or would it be quicker to file once I'm in the USA? Thanks for your response.

File it ASAP. It won't be any quicker if you wait. If you want to travel to the US together then yes, you need to delay your case at NVC until her I-130 gets approved and sent to NVC.

To be clear your husband files for a step child.

Yea he is going to file today! Can I travel to the USA whilst hers is pending once mine is completed? And travel back once my daughter's has caught up? Or is the only option to delay the NVC?

No, you can do that, too.

You can travel without her, but your husband will have to pay a second AOS fee and then you're paying more for flights if you don't wait for her to catch up.  Plus she can't come with you without the immigrant visa.  Chances of her being denied entry when you're immigrating is pretty high even with VWP.

Up to you.

You will need a letter of acknowledgment from her other parent that she is immigrating to the USA.

Yes, I did think that. I would visit England she wouldn't travel out to USA.

It's an extremely complicated situation that I am in and it's to do with court cases with my daughter's father. I have only just been granted legal permission to take her to USA.

I understand.  Life is complicated.
