Need to know about N-400 after I-751 is in pending.

Hi All,

 

I have filed I-751 to remove conditions on my green card. I filled this in April 2018 and my green card has already expired. Have completed my bio-metrics and now waiting to hear on this from USCIS. 

 

I know its a long wait.

I want to know when can I file for my citizenship.

 

Is it a good idea to file for citizenship while I-751 is pending? If yes, when and what is to be done.

 

Please help.

Yes you can file while ROC is pending if you meet the requirements. No issue there...they will likely adjudicate both the I-751 and N-400 at the same time via an interview.

 

Assuming you are married to the same USC that you obtained your green card through, you can file starting 90 days prior to the 3 year anniversary of obtaining the first green card. So if you card says "resident since 1/1/2016", you could file anytime after 10/1/2018 (give or take a day or 2...I didn't count 90 days exactly. Be sure to actually count the days if you plan to file within the 90 day early filing period).

 

Keep in mind you must meet the other requirements for naturalization (good moral character, physical presence, continuance residence, etc.).

@geowrian My green card says resident since 06/17/16 ....what would be the approx date that I can fill in N-400 for Citizenship.

 

I have been in the US since 06/17/16 date and recently filled I-751 to remove conditions on my green card.

im confused now...the date calulator asks Permanent resident anniversary date...is this the date for when green card was issued or when it will expire?

You would input 3 years from your "resident since" date, which is 06/17/2019. The early filing period would be 90 days before that date, which is what the calculator displays.

Question on applying for citizenship while I-751 is pending

 

1.fill form N-400 90 days before the 3rd anniversary of green card

2. Fill the fees again??

3. Any supporting documents to be sent along..
