Hi 

 

I came to USA with my 3 year old son in March to visit my sister and help her with Pregnancy.She had a baby boy in Mid March.

 

This is my second trip, I have been to USA a before as well.

Also I am a recent divorcee. (had  a very bitter divorce last year) 

 

Anyhow when I was here my Parents and Family introduced me with this guy of our  community from back home  who is also a recent divorcee and later we got engaged and married. 

It was an arrange marriage,  a very prevalent method of marriage  in India and in my part of the community.

 

We got married almost after three and half months of my arrival to  USA.

 

Currently we are in process  figuring out of how to file my AOS by means of concurrent filing. 

 

But we are little confused with comprehensive list forms that we must submit.

 

Also I have a 3 year old son and I need to know if he can be filed under same petition or does it have to be a different one.

 

Anyone who has gone through recent process AOS ,  any help/ guidance from you with this process and check list of forms and document we must submit would be really appeciated

 

As at this moment we are not in a position to afford a lawyer,  as my husband is the only bread winner for us  and we are still managing to meet our daily needs of housing and lodging.

Again any help  and guidance would be very much appreciated.

You are permitted to file for AOS if you are currently within the US (and can obtain all documents from within the US).

The child will require a separate I-130 and I-485.

Always read the forms and instructions for the forms in full, and repeat as necessary until you understand them. Ask questions as needed.

I also suggest applying for a work permit / EAD (I-765) and travel document (Advance Parole / I-131). these can be filed with AOS at no additional cost.

 

Your husband will need to meet the financial requirements for the I-864, or find a qualified joint sponsor.

Keep in mind the cost of filing the forms...AOS is not a cheap process.

I-130A won't apply for the child.

I-485 for the child when filed at the same time as the parent is $750 (no biometrics for a child under 14). If filed separately from the parent, it's $1140 (still no biometrics fee due to the child's age).

 

The I-693 has no filing fee, but the medical required to complete it does. The medical exam can be anywhere from a little under $200 to over $400, depending on civil surgeon utilized.

depends on which status you changed from. For me I adjust from B2 so I can submit when i receive the REF/just bring it with me to the interview.

As i know if you adjust from K1 (or the others which im not so sure), you have to submit the medical with the packet.

 

From USCIS website:

Where to File

After completion of the medical examination, the civil surgeon is required to give you, the applicant, the completed Form I-693 in a sealed envelope for submission to USCIS. Do not accept it if it is not in a sealed envelope. USCIS will return the form to you if it is not in a sealed envelope or if the envelope has been opened or altered.

It is the applicant’s responsibility to submit the Form I-693 to USCIS, not the civil surgeon’s.

If you are applying for adjustment of status, you may submit Form I-693 in one of the following ways:

  • Submit Form I-693 by mail, together with your Form I-485, Application to Register for Permanent Residence or Adjust Status, to the location specified for your Form I-485 (see “Direct Filing Addresses for Form I-485”).

With the change in policy about to come in you’d be foolish to leave out anything that should be in. You might just get a denial rather than a RFE

Timeline

Hi 

 

I am in process of going through Medical examination. I have one query regarding Part 2 of I 693 forms. 

What do I put in Part 2 Item # 1 for my 4 year old son. Obviously  he can't read and write and he is not using interpreter as I am filling form for him and I will sign too.. 

So should I choose A or B in item#1. 

 

Any help would be much appreciated.
