Permenent Resident filing I-130

I am a permanent resident since 2009, didn't apply for citizenship cuz never felt the need of it. As, now I am married and applied for my foreign spouse I think its time to apply for citizenship to have her case moves fast.

 

But for now, my question is how long it normally takes for a Permanent Resident's spose to get her visa. What's the current timeline. She's from Pakistan.

 

Any valuable input would greatly be appreciated.

For the spouse of an LPR, this falls into the F2A family preference category. The Priority Date (PD) for F2A is taking roughly 2 years to become current right now, then expect a couple months for NVC processing and 1-3 months for embassy processing, depending on embassy. Pakistan can also have some extended AP times for background checks, although this tends to be with males more so than females.

No, it will still take ~12-16 months from the initial I-130 filing. That's current processing timelines. But this is less than the ~2.5 years for a green card holder due to the limited number of visas available to that category.

 

Edit: Also, she still needs to do all the same work to get documents, do the medical exam, interview, etc. to get the visa. They don't just stamp a passport.

Here's is something u need to know about changing ur case to Green card to Citizenship. When U will apply for citizenship which usually takes more than a year and a half to even become a citizen. After u get citizenship and want NVC to change a case it will make ur case delayed, WHY? Citizenship and green card cases are processed in different time and making change on status will actually slow ur case down because it will be put in citizenship processes and some time it's priority date might be behind. (Check with attorney to see current priority dates and then change) My suggestion will be stay with green card status which usually takes 2 years if everything goes correct. But keep in mind if u have done case after getting ur citizenship that will have expedite the case from start, which usually takes a year or more. Anyway? Get all docs done correct and make sure to gather necessary docs and get ready for interview. GOOD LUCK and if have question feel free to ask

Spouse of a USC is in the immediate relative (IR) category, so the PD is always immediately current. The only way it would be slower is if one were to upgrade the petition within a couple weeks of the PD becoming current. The PD for an IR category visa can never be current after that of the PD for a family preference category visa (i.e. F2A).

There are two scenarios when heshe becomes a USC:

  1. The I-130 is still pending
    He sends a letter to USCIS for upgrading petition
    Depending on his service center and when he filed, it can differ. If he became a USC 1-3 month after filing USC, he still likely has to wait for 6-8 months for I-130 to be approved. If it is late like 6-8 months after petition it can become quicker.
    While I-130 is pending the spouse may or may not get a B2 visa. its a hit and miss
  2. The I-130 is approved and sent to NVC and waiting for visa availability under the F2A
    He sends a letter or does it online to upgrade petition. (he will likely have to follow up a few times to make sure it is in the system based on other experience)
    Still will need 2-3 months for consular processing.
    Even if visitor visa is approved, she will likely be denied entry at POE unless she has really strong evidence and shows proof she has elected to do consular processing.

 

 

I'm in the same damn situation. I am expecting my USC within the next 3 months, wife's I-130 was filed a month ago. and she just filed for visitor to US and canada so we can meet this year to spend time together.

Just out of curiosity that why not apply for B2 prior to filing I-130 petition? You didn't realize the possibility for wife of visiting the US and the idea came up after petition filing?
