Abandoned K1 Visa: want to start over again?

So I have decided to abandon my K1 visa because me and my fiance had a horrible break up which I don’t want to discuss. My question is, will I still be able to visit on an ESTA (visa waver program)? Also, how long would I be able to wait before I can visit the US again? Is there a set time?

That's really unfortunate.. 

You can visit in visa waiver without any issues. There is no set time.

So I recenty abandoned my K1 visa due to a horrible break up with my now ex fiancé.

 

I have found a new guy who also lives in America (and fallen in love with), and am planning to visit under my ESTA (Visa waiver program). I’ll visit him for a week and then again for a month. Now in that month we plan to marry each other (whilst on my ESTA) and I know this is legal only if I go back to my home country (UK) after the marriage. I will then plan to file for a CR1 marriage visa, my question is.. will my abandoned K1 visa decrease my chances of immigrating or obtaining a CR1 Visa? Is my plan possible to do? I want to know your advice and opinions on this.

Not yet. I’m waiting until October to visit him for a week and then staying for a month in December. We both want this really bad, we even started filing out the CR1 in advance just incase. (I’m 19, and he’s 20 in the military if that helps).

Well... technically I didn’t just find a guy after my breakup. I’ve been communicating with this new guy whilst I was with my fiancé and back in England while I was waiting 9 months for my K1. I had no idea I was going to fall for him, this is kind of why me and my ex fiance broke up and didn’t go through with the K1. And divorcing him would just be fraud. This is why I want to start over.

You'll have to admit that during your interview and it will add to the scrutiny. But good luck.

Did you actually get approved for the prior K1, or is it still pending?  Your other thread this morning implies that you have just decided to abandon the process.

 

Have your ex fiance do a formal withdrawal of the K1 before filing any new petition, is my advice.  If the old petition is not withdrawn, could possibly affect the new one.

Be prepared to explain all of this in detail at the interview... I believe that you might face some heavy scrutiny from the co during the interview especially since you stated above that you were communicating with another man while being engaged to another man and pursuing a k1.

 

I believe  you are facing an uphill battle to prove a bona fide relationship.

My guess would be the talking to this man led to the break up from last fiancee and subsequent abandon of the last k1, I hate to say it but a previous member mentioned visa shopping and that is what this sounds like.

Op, just please think long and hard about your choices for yourself and the new American man you are involved with and be prepareed for alot of questions and scrunity during your immigration journey.
