Timeline

My lawyer just posted a link on her website from USCIS https://www.uscis.gov/news/news-releases/uscis-updates-notice-appear-policy-guidance-support-dhs-enforcement-priorities . Its seems scary.. like whats going on with sudden movements? I know this used to happen before trump too but why its being highlighted during his term?

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

everything on there seems like common sense to me.

 

unless you are here illegally, committing fraud or other criminal activity, its nothing to be concerned about and is a good thing.

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

Yeah. That what I thought too.. meaning deportation used to happen before trump came to power as well but why its highlighted during his presidency? I mean what special he is going to do? I had a simple misdemeanor case before I came to the United states which was later dismmised and it was disclosed in my cr1 application. I hope I am not affected? My lawyer posted me this link which got me little worried..

The revised policy generally requires USCIS to issue an NTA in the following categories of cases in which the individual is removable:

  • Cases where fraud or misrepresentation is substantiated, and/or where an applicant abused any program related to the receipt of public benefits. USCIS will issue an NTA even if the case is denied for reasons other than fraud.
  • Criminal cases where an applicant is convicted of or charged with a criminal offense, or has committed acts that are chargeable as a criminal offense, even if the criminal conduct was not the basis for the denial or the ground of removability. USCIS may refer cases involving serious criminal activity to ICE before adjudication of an immigration benefit request pending before USCIS without issuing an NTA.

The revised policy does not change the USCIS policy for issuing an NTA in the following categories:

  • Cases involving national security concerns;

  • Temporary Protected Status (TPS) cases, except where, after applying TPS regulatory provisions, a TPS denial or withdrawal results in an individual having no other lawful immigration status;
  • DACA recipients and requestors when: (1) processing an initial or renewal DACA request or DACA-related benefit request; or (2) processing a DACA recipient for possible termination of DACA.

 

Don't commit fraud or misrepresentation. Don't abuse any program related to the receipt of public benefits. Don't be convicted of or charged with a criminal offense or commit a chargeable offense. Don't unlawfully exist in the US. If you do, then you should be scared anyway regardless of this article being updated/posted.

Well I am one of those people who go by the books.. so I am not worried on that part but any small changes makes me nervous as I had a simple misdemeanor before I came here and as I have mentioned before it was disclosed during my cr1 application. I always have attorney but this time I think she was exaggerating the situation so I got concerned that If I will be effected in any way.

If you are going by the books with your process, you have nothing to worry about. Unfortunately, some attorneys like to induce fear or anxiety/worries in people so they can generate more business. If you browse the forums in general, you will see many instances in which attorneys have actually given incorrect advice all together. Not saying that your attorney is bad at their job, but just to take these things with a grain of salt.

 

It also has nothing particular to do with the current administration. The things I read in that article do not sound new to me; perhaps just updated verbiage to remain more current and relative. Procedure wise, still looks pretty much the same. I don't think it's necessarily being "highlighted"; procedures/instructions/forms routinely get updated to remain cohesive with existing conditions or needs.

This memo only applies to the aliens who are removable or inadmissible. So, for example, if you're not lawfully present and get charged with a minor misdemeanor, that could be a problem. However, if you are in good status, none of these guidelines apply to you, so relax.

12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE
12/21/2017 Response to RFE received by USCIS 
02/09/2018 I-485 approval (text, email) :)
02/08/2018 I-485 approval notice issued (the "welcome letter") - I'm LPR now
02/16/2018 Green card received
