Plan for marriage-based Canada to US immigration?

Hi,

 

My boyfriend and I are planning on getting married and for me to apply to move to the US using marriage-based immigration once I’m finished grad school in Canada. We aren’t married yet, but I’m wondering if the location of the marriage certificate matters to US immigration? Does it affect the application whether we get married in either the US or Canada, or in another “third-party” country such as Mexico? 

 

Also so does having Nexus allow your application to be processed more quickly since I have already been vetted by CBP?

Where you get married doesn't really matter. What matters more is timing and ensuring you do everything properly IN ORDER. For example, you can get married in the US. But it depends how you want it to play out. For CR-1, you can get married in the US but then you have to go back to Canada and wait until you are approved to move completely to the US. I'm guessing this is what you want since you are in the CR-1 forum. As long as you provide a copy of the marriage certificate, have some photos of the ceremony (even if it's small), it doesn't matter where you get married.

 

Nexus does nothing. Sorry but processing times are really long now and nothing speeds up or slows down your case. It happens how it happens. CBP also is not the same as USCIS and they do not play an active or major role in USCIS' adjudication (for the most part). CBP determines your intent at the border and that's it. USCIS has to do their own vetting of applicants and it is much more thorough.

Spouse petition and visa decisions are about lots more than security risks.  It doesn't matter where you marry.  Married is married.  Count on 12 to 16 months and hope things speed up.
