O1 / EB1 visas examples of success stories?

Hey there! :)

 

This is my first post on the forum and I am pumped to see so many of you working on getting your visas. It is inspiring to see others in similar situation.

 

I would really appreciate if you can share stories / examples (links) to people who managed to get the O1 or even better EB1 visas. I currently hold the B1 / B2 visa that expires in 2 years and allows me to stay up to 6 months, also I am Polish nationality.

 

From my research so far (2 days on the phone with embassy staff, gov websites, Q&A in Facebook groups, searching YouTube) I see 3 out of these categories should be met: art displayed in professional galleries, playing a critical role in a successful organization, membership in distinguished organizations, peer-reviewed articles, citations to published work, commercial successes in the performing arts, reference letters from experts in the field, judging the work of others individually or on a panel and some others.

What I would love your help with is - specific examples of people who got O1 / EB1 visas meeting above requirements. I found so far 28 year old Russian girl Marina, CEO of LinguaTrip from linguamarina YouTube channel. She explained examples of documents provided in a YouTube video - if someone else is interested in this topic.

 

I am currently 22 and building a business in film / video industry. My intention is for it to also help me with this green card goal. I realize this may take years but I want to reverse engineer the model to intentionally check as many requirements as possible.

In the area in which you work, getting an O1 is feasible. However, you need to get good experience and your name on projects. You also need to belong to some professional organization. They require evidence of expertise and also, letters of support/recommendation indicating you are an expert on xxx. Of course, it is easier to be an expert on something more narrow. Instead of being an expert on film you could be an expert on TV soap operas, or music videos, or TV commercials, etc.

O1/EB-1 are all about how the evidence is portrayed.

They are very common in my industry, and I have seen other people try to do it themselves, get rejected, and then re-do it with a decent specialist lawyer with exactly the same information presented better, and get approved. It is a lot of paperwork and evidence.

 

Speak to a decent O lawyer. 

 

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Hi Anna,

I'm a graphic designer and successfully got a O1-B Visa in 2014. I know at the time my case wasn't super strong because I was only 2 years out of college and hadn't a whole lot of experience under my belt. But thanks to me winning a national award, my work being featured in 2 books and my contribution of work to 2 global brands I met the criteria.

 

It's definitely important to present your case clearly and be detailed with your supporting evidence. My petition of evidence ended up a 120 page document! A good lawyer is important too. I really think my strong recommendation letters from clients/employers were a big part of my case. When reaching out to them to write me reference letters I asked them to please describe my 'extraordinary talent' and whether I was a 'leader in my field'. I really think it's important to use the terminology that is linked to what this visa is about.

I got an EB1A as a musician in 2016, but I was already close to 20 years in the biz at that time. So I had a bigger resume catalogue to pick from. I never went for an O1 visa, but was considering it first. You can try to somewhat find you place, evaluate your chances, by looking at others, but at the end if somebody is not in the exact field, country and competing with you directly, it wont help you that much, in fact might even falsely intimidate you. 

 

What matters at the end is your own confidence, achievements and finding the right lawyer. I had many consultations before I picked mine and can say some were totally the wrong fit for me. I could have also regretted it big time! One even said I have no chance on O1 or EB1. That was partially to the fact, he wasn't paying attention much, not specialized in the field of arts and I didn't presented my material right for the evaluation.

 

Just from what you write here its not possible to evaluate your chances, neither I see myself really capable of doing so anyways. Also, every case is different and I can be a very subjective process.

EB1 as a Research Scientist and I was 30. They do scrutinize every evidence you submit and it is a ton of paper work and so I echo seeking the help of a competent lawyer.

Regarding what evidence I provided: Copies of publications in high quality peer reviewed journals (along with the impact factor of the journal), copies of patents, letters from eminent international researchers (with whom I have no professional/personal relationships) who cited my work in their journal publications and wrote a letter attesting to my contributions in my field and how they used my results to further their own work, and finally a summary review of my research impact from scopus.

 

Trying to game the system is not very wise and checking boxes on a moving target (i.e. immigration climate) will only add to frustration. If you are passionate about your work and confident in your abilities and make an impact, then all the evidence will automatically create itself!  Good luck!

I have the same situation with you holding on B2 visa in USA, are you planing to submit application in USA and change status directly if the case is approved?

Entry into the US on a B2 visa requires a return ticket; therefore enter on a B, return home on that B.  Better to submit visa application in home country.

10/19/2017.......... I-797 NOA date

10/30/2017.......... Notice received in mail

11/02/2017.......... Conditional GC expired

If you are already in the US on a B and have been there for a considerable amount of time - 4 months or more, i would think - and you filed the O when you were in the US, then I believe you could change status. Especially if you were on a B for medical reasons for example. it depends very much on the details of your situation. but you can't just go to the US to change status.

Seems too many thing need to worried when if change status in US when under B visa, it is better to do consular processing...

It should be easier to get EB2-NIW in your case. This is an old post so I'll share my experience if you're still interested. Either way, good luck!

03/12/2016 Case received by Nebraska Service Center (NSC)
03/14/2016 Text notification received for I-140/I-485/I-765/I-131.
04/08/2016 Biometrics notice received for 04/21
04/13/2016 Biometrics early walk-in completed.
04/15/2016 EAD/AP combo card received in mail.

12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE
