My children are currently aged 15,13,12 and 10 my question is ........ do their ages freeze at the age I file for CR-1 ? 

My partner and I plan on getting married when I head over to the State this September and start the process, so my eldest will be 16 by then.

No, but they freeze when you file the I-130 for their CR-2. CR-1 is for a spouse, CR-2 for a child. You must petition each child separately.

Oh yes sorry that’s what I meant! So regardless of how long the visa takes the boys ages will remain at 16,13,12 and 10 when we file their CR-2?

Also do you know if generally children get approved at the same time as the filing parent?

They will be treated as those ages for purposes of obtaining a visa, so long as they seek to acquire an immigrant visa within 1 year of the I-130 being approved.

That said, as long as you marry before they turn 18, you can petition them at any point before they turn 21 and it won't change a thing.

Generally, I-130s for children are approved at around same time, but you can hold things up at NVC if not.

From what I understand, you cannot come over to the states with the intention of getting married and staying in the US while your case is processed. If your intent is to get married when you arrive then you must leave while it is processed. 

 

If you can prove you got married without the intention when you entered then you can stay while it is processed.

Just to clarify the above...

You can marry in the US fine. But you must still process the the visa abroad. You can't enter the US with intent to stay in the US.

I don’t intend on staying, I have a house, job and the boys still in Australia so my intentions are to visit, marry and return home while the process happens
