Divorce: signed letter from USC

You will need to file ROC with a divorce waiver. ROC is based on your marriage to a USC. If you two are no longer together you can't do it the normal way. 

 

When you file you will need to have a divorce decree.

Follow the guide of the  I-751 but also include in the evidence of the circumstances of your divorce and any documents of the divorce proceedings (notices served). If the divorce is final before you file then add in all court documents and final divorce decree. If a letter from your spouse will show that you entered the marriage in good faith (in other words, that it was not a fraudulent marriage) then, yes a letter from him can help. When you file you will be requested a waiver with the I-751.

 

When you are interviewed you are going to explain about how you entered the marriage in good faith but the marriage simply did not work out. If your husband can support you on this and not claim you frauded him, then you can use him. Best to consult with a competent immigration attorney with this type of experience also.

After my spouse filed for divorce, should I file an answer? (so it can be used as part of the evidence I submit for ROC) Has anyone here filed an answer?

 

Is there anyone here that got divorced? Were you living together while going through divorce? Did your spouse make your life hell while waiting for the divorce to be final?
