I returned to Canada before ROC but have a change of heart

Hi Everyone,

 

I know this may sound crazy, but I was not happy with my husband and we were to file for removal of conditions this August.  Long story but I have had a change of heart and we are committed to working it out.

 

Is it too late to go back now or do we have to start again and do the married route.  I left at the end of May to return to Canada.  I have not yet sent back my 2 year conditional green card.  I was going to do that this week. 

 

Please advise on what to do and thank you in advance.

RFIE accepted August 24, 2016

EAD Card is being produced September 13, 2016

Green Card is being produced November 17, 2016

AOS Approved November 18, 2016

No, it is not to late at all. You still have your unexpired so just go back and be with your husband.

But when I came back to Canada I said I was returning to Canada and reimported my car.  Would I just reimport my car back?

 

Confused and a bit scared.

Interesting question. I'll leave it up to others to give you expert advice. I'm curious to see how someone might affect their status as permanent resident without officially surrendering the green card. I'm guessing you're fine and your green card  and your status are still active.

 

EDIT: Good luck on your relationship. The first couple of years is not easy.

Confused? Scared? why? Have you been outside more then a year during your last 2 year span? If it's only been since may you will have no problem coming back. You are allowed to come and go as you please with your green card, just not more time outside the us then inside. 

 

If your afraid of your relationship, maybe you should work on that?

No, I was afraid that I would not be able to come back unless I forfeited the 2 year green card and then have to reapply.  I have been in and out of the US for work and family visits but I said at the border that I was returning so I thought that was that and I wouldn't have any recourse but to reapply with the CR1 and wait a year. 

 

We are working quite hard on the relationship and thank you for noticing that as it is the most important thing out of all of this crazy stress.

No reason to be scared. What you told the Canadian border agent has no bearing on what the American government has in your file. Ie, it's not like the Canadian border agent called the USCIS and said, "Hey guys, I had a Canadian GC holder today who said she's returning to Canada." USCIS would only have officially changed your status if you had surrendered your GC. Go back to the US, work on your marriage, file RoC and you will be okay. Good luck. Can't advise about the car though because I have no idea about that.
