Federal judge filed the stay based on what? Multiple criminal violations, if he is here illegally no valid ssn, so he is either avoiding taxes or has an unlawful ssn, boss aware he is illegal, no charges filed. 

 

Sad the laws only apply to citizens and legal immigrants

Honestly, I think if the media/public officials/Gov. Cuomo hadn't put on the pressure the stay wouldn't have been granted.

I feel bad for the guy, I do...but there has to be some sort of consequence to his prior actions....a huge fine, something.

According to another article I read on this, his wife said he files taxes every year...(I presume he uses an ITIN number to do so).

Interesting , eight years of avoiding a deportation order and not being discovered is now considered an expedited removal.  I guess the wife an kids may want to start making plans to live in Ecuador.

Considering he'd filed his GC application in February, you would think that as soon USCIS started doing the background/name checks this would have come to light...especially if he disclosed on his application the previous removal order from 2010.

If he entered legally so many years ago...and then filed it (finally) based off his marriage to a US citizen...guess it would be technically eligible to file?

 

Being actually approved for it, is another story of course as I think the removal order would trump the normal "overstay is forgiven with marriage" clause.

I suppose anyone can file for a green card. Filing for one means nothing. Getting approved is a different matter.

 

Kind of like unscrupulous car dealers advertising, "No Credit application refused. Approved is a whole different matter
