Hey there, my now wife is still awaiting her EAD since Feb, we went to SSA to change her name, they said no cause her Plastic EAD is expired (she has an extension letter so it is still valid), and her USCIS name shows her maiden name, SSA said we have to change the name on the EAD first,

how can we go about changing that while it's still in process?

Will it now take more months to wait for USCIS to change he name on the incoming EAD?

Did she file for AOS in her maiden name? If so, her green card will also be issued in the maiden name. If so, I suggest contacting USCIS to change this...hopefully they can do so before AOS is approved. Otherwise you'll need to file an I-90 later to get the green card in the new name.

 

As for the SSA issue, there' may not be much you can do until they update her name with USCIS and issue documentation of that  (a green card or EAD). If you're lucky, you can get an employee that may have better luck (since the marriage certificate is a legal name change document). It took my wife 3 visits to the SSA to get them to issue an SS card in her married name (although her K-1 was still valid...she didn't have an EAD yet).

 

As for getting the EAD corrected, that would involve a new I-765 (either concurrently or after they update the name on the I-485, as noted above).

Actually going to note that she isn't in AOS yet as she's TPS status and we still have to get a AP for her legal entry

Ah, okay. First thing is I would suggest checking this thread and figure out if being paroled into the US (via AP) is actually needed to AOS. Just a suggestion.

 

Beyond that, the previous comment still applies re: hoping to get an SSA employee that will recognize the marriage certificate as-is, you needing to get a new EAD (or a green card) in the married name.
