would it increase my chances if I waited until my greencard arrived and then abandoned my greencard?

No one can exactly tell you but chances are, your chances of ever getting a tourist visa again to the US is slim to none. You violated your immigration visa and law. Your record will be logged and follow you whenever you apply for another tourist visa to the US. It is entirely up to the CO and the ties you have to your country.

No, not at all, imo.

ESTA or VWP is a privilege which you lost by overstaying.

Getting Visitor visa is very hard for you but again not impossible. For visitor visa, you got to show nonimmigrant intention. By overstaying ESTA and AOS you have the immigrant intention (even thou you left in middle).

I wonder if you can get Business visa. You can visit the US while you come for business meetings, conference and extend a couple of days and visit your wife's family.

I really feel bad for you. The lawyer who suggested you overstayed is basically the one who rocked your boat, well at this point sank it! I know some people would feel it's your fault, but in my opinion you simply followed your lawyer's advice and unfortunately it wasn't a good one. You can only hope, after abandoning AOS and going back to your country, that you will get a visitor visa anytime soon, if at all.

If I do a bad job I will not get payed by the costumer, and I will have a complaint filed with FL. DPR . Lawyers, Politicians, and Doctors always get payed no mater the outcome. This is the complete system the Lawyers set up in this country.

Agree with other people about ESTA, and it will be hard to get a B2 again as it will look like you are coming back to adjust status again. Also it doesn't sound like you want to PERMANENTLY move back to Scandinavia. Why don't you use your advance parole to travel there, come back here for at least your interview, then after you get your greencard if you want to be in Scandinavia apply for a re-entry permit that lets you live outside the country for up to 2 years (with some caveats)? Nothing here is meant to suggest abandoning ties here and therefore not really residing in the US but if you ever plan on living in the US in the next 2-3 years this is the way to go.

Also get a new lawyer - he guided you to overstay and then he doesn't even know that an overstay means you can never use ESTA again. He seems bad at his job.

I have to ask..do you play League of Legends @Teemo:lol:

About leaving the GC process..yes, sadly you won't be able to come back under the ESTA and they will probably have you red flagged because of overstaying and everything else when you ask for the visa itself to come back to the US(which will make it harder for you to come back but not impossible..you'll just have to double proof them that you will come back to your country once your trip is over).

No, I don't think it would make any difference. You overstayed your stay. Maybe you get a visitor visa, maybe not.

A business visa still has to overcome 214(b), exactly the same as a tourist visa

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

After our relationship breaks down she admits to me that she had never bothered to start the application process

That's what I was thinking as well.  Less possibility of getting a business visa in OP's situation due to the overstay.
