DOES PETITIONER OR BENEFICIARY SIGN G-1145 FOR AOS?

Hey guys. 

 

I'm completing the AOS stuff now and wondering if the beneficiary's name goes under the "Applicant/Petitioner Full Last Name" or if the Petitioners name goes there.  With K1 the petitioner was obviously the USC but now that I am applying for AOS would it make me the petitioner? This is for the G-1145 E-Notification form.

I, as the USC, signed that form and got the text notifications and all.

Petitioner is always the USC. It doesn't matter whose name goes there. It just depends on who you want to receive the notifications. I'm the applicant and have received all the notifications.

Technically, if you're only sending the I-485 (with or without an I-131 and/or I-765), the filing is the alien applying for permanent residency. The petitioner is irrelevant except for the I-864 (and showing a bona fide marriage, obviously). So I would say it should be the non-USC.

 

But in practical terms, it really doesn't matter. They just need somebody to agree to receive the notifications. Sending messages without prior agreement can be a violation of the CAN-SPAM Act. They're just covering their neck that they made the best effort to avoid sending messages without permission.
