Bringing my fiance to America to marry and stay for good.

My fiance lives in Nigeria neither of us are rich or well off... Once a long time Commercial Truck Driver I am now on Social security disability at the moment for Heart Failure  I receive enough for us to live on together once she is here plus she can always get a job to help out... I have a home and transportation already waiting for her... In my current financial situation with all of my monthly bills it takes a long time to save up for traveling expenses because  there is little left over at the end of each month. 

 

Can anyone advise what is the cheapest and fastest way to get this process moving and get my Fiancé to Alabama... We met on Facebook and have been together 4 years we do face time often and talk or chat daily on the phone. 

 

What Visa route would be best for us?

You can’t do anything until you have met face to face (in person).

 

Each process is a trade off in terms of cost and speed.

 

Fiancée visa is faster to get her physically here but costs more and there is a delay once she is here in getting her able to work.

 

Spousal visa takes longer but is cheaper and she can work as soon as she gets here.

 

Unfortunately her country is high fraud so marrying on first trip can be a red flag and fiancée visa has been rejected a lot at the embassy stage (though petitioner being male helps this a bit).

First of all, have you met this person face to face?  Because if you have not met in person yet then there is no path for you and her.  Remember Nigeria is a very high risk country so you will need to visit her a couple times.

if you have not met in person then it's pretty much a no go at this point in time until you meet. There have been waivers that were granted in the past for not meeting but those are few and far between.

As @cyberfx1024 mentions to get a waiver for meeting is like finding hens teeth (exceptionally rare). For religious reasons showing that your religious customs prevent you from meeting even in the presence of others or for medical reasons showing that you cannot travel to meet her (even in a third country traveling by land or other none flying mode that can accommodate your illness) or that she cannot travel to meet you (multiple attempts at US or other country visas).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

When you say you have enough to support the two of you,  have you checked the immigration poverty guidelines?

others asked 'have you met in person?"

chances of getting a K1 financee visa approved in Nigeria are slim

chances of a CR1 spouse visa (marrying on 1st visit ) also slim

you will need to meet her and spend quality time with her / several visits to wade thru the immigration process for Nigeria

 

Everyone asks "What is the fastest way?"

there is no fast way

and the best advice will be from the experienced here and those who have gone thru the process in Nigeria

I don't want to burst your bubble or come off as insensitive, but the visa process is not cheap nor is it fast.

 

The two options for those who intend to marry are the CR1/IR1 and the K1. The CR1 requires you to get married, and then you petition for your spouse to come to the US. The K1 requires you only to be engaged and you petition to bring your fiancé here with the intention of legally marrying within 90 days of their entry. I tell everyone with the question you have - take the time and effort to extensively research both options VERY WELL so that you both understand the process, the requirements, the circumstances, and the consequences. For example - on the K1, the beneficiary is unable to immediately work or leave the country once they arrive, unless they submit a work permit and/or Advanced Parole application, which still takes a few months to be approved. Make sure you BOTH understand all of the details so you are aware of what your deal breakers are, and what they are for your partner.

 

If you don't meet the financial requirements independently, there are options for having a co-sponsor - basically someone who will assist with financially supporting your non-USC partner.

 

As others have said, you are also required to have met in person within the last 2 years. You are required to provide sufficient evidence of your relationship, including any visits either way. Again - something to research so you're aware of the requirements and evidence that will be needed. It's important to do this before you even submit any petition, as none of the fees you pay along the way are refundable regardless of outcome.
