Supporting documents for I-130 Petition

Timeline

My husband will going to file the i-130 petition (spouse benificiary) As stated in the general requirements, there are supporting documents to be attach in the i-130 application. As of this time the only document we have is the birth certificate of my son. We dont have the Other documents to support that we have bona fide marriage. Any recommendation? so we can file the complete requirements to avoid any delay. Actually this will be the third time that my husband will file fir our petition. Hoping by this time uscis will process it without any problems. Thank you.

Timeline

Certified copy of your marriage certificate is all you need. The supporting docs can be submitted later on at the NVC stage or at the embassy interview.

Thanks. So no need to send evidences such as photos or proof that we decided to get married because we want to be together and not just for immigration purposes?

The only evidence docs that we sent to USCIS are a certified copy of our marriage certificate and copies of our children’s birth certificates. But the BC is optional ofcourse not everyone has kids. 

 

The photo, money remittance, and chat evidences I brought to the embassy interview. The consul only asked to see the pictures.

I am from the Philippines. Aside from I-130, and i-130a, do i need to send a possport size picture to my husband and include it in the petition even  I am not in the USA?

Yes. Passport size photos are required for both the petitioner and beneficiary. Include both in the package. 

 

The i130 instructions are pretty straightforward.
