Timeline

My same sex spouse and I were married last month. She overst aged her visa nd we have not begun the application process. I have twork young daughters and we were living in a small apartment we had been renting for over a year. Our landlord said she had to lose us as tenants over a dispute we had over some furniture she removed from a shed we were allowed to use. We left, then yesterday she began sending messages about coming to my wife's job with ice and that she wI'll turn her in. We are very afraid, but the story goes back further, when we rented it was only my name on the lease because my wife doesnt have an ssn. She knew it, and offered her employ mentioned for a few months. So now she's pulling this. We don't know what to do.

You have to file both together. 

It's a tough situation but unfortunately filing AOS is the only way to make sure your wife won't be deported.

I agree with @Roel.  I wouldn't delay filing AOS. Just my 2 cents.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Ask family for money, take a loan, anything. You really don't want to deal with possible deportation and depending on how long your wife overstayed, possible ban on entering the USA again. 

 

The reality is, she should stop working until she receive proper work permit. 

 

What visa did she arrived on and how long she overstayed?

Yeah she will have 10 year ban if she leaves USA. Sorry we don't really have any other advice for you.

Be very careful. ICE is arresting people at their GC inteviews as they adjust from overstay to legal immigration. It was recently on the News.

You may want to search for pro bono immigration lawyers/ associations so if the worst happens you have as much documentation/ council as possible.

My wife has never been in removal proceedings or illegally entered the country. This is all my fault... I moved to Mexico to be with her but with my two young daughters and the criminal and homophobic environment we just couldn't handle it. She applied for a tourist visa to help me move back to usa and would only have stayed with me for a month or so and not overstayed, but I love her and begged her to stay.
