Timeline

Hi all - working to get all documents prepared to file for I-751 in May. I have a question regarding Affidavits. It looks like we will need two. Any suggestions on who these should come from? Is it good to come from friends, family, boss, etc? I was thinking of friends / people we house sit for and then my boss so it is someone outside of the family, does that really matter? Do they need to be U.S. Citizens or could it be my husband's sister? Thoughts? 

 

"Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship.  (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.)  The original affidavit must be submitted and also contain the following information regarding the person making the affidavit:  his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge.  Affidavits must be supported by other types of evidence listed above."

 

Additionally, how long and in depth should these be? Thanks for any and all suggestions.

ALSO - I have done a lot of reading and searching about this on here. It seems like people are saying affidavits are optional. To me it does not look like they are optional when I read the form. They are listed as #5 as Required Evidence. Correct? And I'm assuming these also have to be notarized?

Yes they need to be notarized. We send 4 of them with our RFE, we used family members. "Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. This answers your other question, as long as they both know you and have knowledge your marriage..  I used the example form http://www.visajourney.com/content/examples

These are the instructions for submitting proof.  

 

"Submit copies of documents indicating that the marriage upon which you were granted conditional status was entered in “good faith” and was not for the purpose of circumventing immigration laws. Submit copies of as many documents as you can to establish this fact, to demonstrate the circumstances of the relationship from the date of the marriage to the present date, and to demonstrate any circumstances surrounding the end of the relationship, if it has ended. The documents should include, but are not limited to, the following examples:"

 

Nowhere does it state you must submit affidavits, they are just a suggestion to include them  There is much discussion about this in prior threads.  If you look at CookieCat's thread you can find some good discussion. 

 

 

People have included them when their evidence is not sound.  Eg.  they don't have many combined assets, have wills with spouse as the designated beneficiary, or joint accounts.

Got it. Thanks for all the info. I will likely just err on the side of caution and include as much as possible. I guess I would rather have too much than too little and not leave any reason for an RFE. Thanks again.

We included two notarized affidavits from my in-laws that attended our wedding. We also live with them, so we used the affidavits to explain our living situation (and lack of rental agreement, public utility bills, etc.)
