K1visa denied should I apply for tourist visa

If my k1 visa petition was refused and haven't been told why no letter or docs returned yet, should he apply for tourist visa?? Is there a specific amount of time to wait? Or is it likely to be denied due to recently filing a k1 visa?? Please assist.

why was it denied? considering there is a record of a K1 visa application on the system, which is proof of immigrant intent, it may be difficult to get a tourist visa.

Why would you need a tourist visa? You filed a k1 so it means you want to move to the USA pernamently. Using tourist visa for immigration is a fraud.

There is no way anyone would be able to get a tourist visa after getting a K1 denial. You already stablished you have immigrant intent when you filed for a K1 and a tourist visa is a non immigrant visa and you need to prove you have no immigrant intent which you do and they’ll know. You’ll be wasting your money. Find out why the K1 got denied. Either fix the denial issue and apply again from scratch or go get married and apply for CR1, which is the more obvious route for anyone with a denied K1. Good luck.

Was it because of something that was on the missing police certificate? If so, a tourist visa is unlikely for that and the obvious other reason (immigration intent).

I agree with above.  You have strongly demonstrated immigrant intent.  I doubt any reasonable Consulate Officer would issue a tourist visa to such a high risk applicant.

Why do you need a tourist visa for? I guess, to adjust your status once arrived? Never ever do this.

 

Getting a tourist visa after denied k1 is almost impossible. You've already shown your immigration intent. You can't get and use a tourist visa to trick the system and skip the immigration process. It will bite you very hard in the future.

 

Sorry to be harsh, but there will be no tourist visa for you. Marry and apply for a CR1 if you really wanted to immigrate to your relative.

The same embassy that refused your visa is the same embassy that will assessing you for the tourist visa.  They have your entire file on screen in front of them.  If your fiance still wants to marry, then you will need to find out why there is a refusal, and correct the issue and then file for CR1 after you marry.  Otherwise, you are free to apply for the tourist visa and go through the process and interview, but you will be denied a tourist visa.

Chance of a getting a tourist visa from JA is already slim but after K1 denial is nil. You mentioned in another post abt the police certificate. Why was he denied? Depending on that, even a CR1 could be delayed.

CR-1 spouse visa is your way forward really...

 

Dont waste your time with the tourist visa. It is for tourism and short visits, and this isn't your intent !!!
