Expiring Visa | Valid I-20 (DV LOTTERY)

Hello,

 

I came to Houston, TX on an F-1 visa back in Dec 2013. I graduated last May 2017 with an Associate in Business. I'm currently on OPT (from August 2017 until August 2018) and planning on getting a Bachelors in Marketing or enrolling in another Associate program. My visa expires on December 2018 but I know that as long as I'm enrolled in school I will be still in status.

 

I enrolled in the DV-2019 lottery and my question is -- in case I win:

 

1. Will the fact that my visa is expiring affect my Adjustment of Status? Or is my I20 and I94 (D/S) that really matters?

2. Let's say that on May I discover that I did win the lottery, when will I be able to apply for AOS? I know that I have to wait for my rank number but when do they start announcing that? Right after the results or starting October?

Timeline

1. If you are selected, as long as your are on valid status (per i-20 and/orOPT fullfillment) till you are allowed for AOS, you can do so. F1 visa has no value while within the US.

 

2. starting from Oct 2018. You need to check uscis visa bulletin each month. If you number is under the numbers listed for your birth country/region, you can file for AOS

So, at a minimun, you have to be in status till Oct 2018. Then it depends on which month your number comes up.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
