Hi guys, Just need some advice on filing the AOS.

So, here's our scenario.. We just got our NOA2 recently and we are just waiting for our NVC number. And while we are researching about the whole k1 visa process we looked into the AOS stage and we found out that kids who are under 13 years old will only have to pay like $750 instead of the hefty $1140 but it says we need to file it together. (Im not sure if Im reading it correctly though). The thing is that, I will be going to the US first and the kids will just follow me after 2 months. We really need your help on what is the best way to file the AOS for all of us in order for us to save some money too cause we have 3 kids under k2. Thank you so much in advance for your help and advice.

wait until they come to file adjustment of status and then your husband will have to file for everyone at the same time, separate packets,

does he have enough saved to file 4 i485 at the same time?

Thank you so much for your response @aleful 😊

So you mean after we got married I will not file for the AOS yet, instead, wait for my kids to arrived at the US before filing the AOS together. Is that right?

We are still working on our savings for the AOS stage for us. That's why we are trying to decide which option is best for us were we could save for the fees.

exactly

there is no time frame to file adjustment of status, the only requirement is to marry within 90 days of arrival. If they are coming 2 months after that, then it is best to wait to file for everyone if you want the children's fee to be less. It is a lot of people

Just don't plan on leaving the USA to escort the kids to the USA

YMMV

Yeah. We are thinking about my dad who will be escorting the kids in the US.

I do have another question though. How could I get a driver's license if I don't apply for the AOS yet?

In most states you will not be able to unless you can prove your legal status...  In a lot of states that is EAD/AP card.  In a few states it is green card.

Check your individual state for the specific rules that appy to you

YMMV
