Timeline

My husband and I have been together for 5 years. I filed his I-130 which was already approved and sent to the NVC. My Husband was previously here in the united states for five years. he left the US in 2011 and has been in mexico ever since. Two years ago he applied for a tourist visa which was denied because of his unlawful presence under the 212(9)(B)(ii) and it states that he is ineligible until 2020. My question is can i file the I-601 now? his PD is June 8,2016 and I'm hoping he can go to and interview at the Juarez U.S. Consulate with a waiver approval already in hand.

Timeline

If he was in the US only once i belive he has to apply for the I601 if that gets approved then yes he may have the visa granted as well at the interview. Good luck.
