K1 visa denied

Hi All

The visa was denied to my fiance this morning. I just don't know what to do now. And I don't know why. He said he answered all the questions right so I'm confused and desperate at this time.

Anyone knows what I should do next? Please help please.

What were the questions asked of him, and how exactly did he answer them?

Without knowing this, we can only speculate as to why he may have been denied.

 

Other option would be for you to marry in his home country, and then apply for the CR-1 spouse visa.

Just basic questions how we know each other what i do for a living where do i leave. Then few years ago when we had no intent to marry he applied to come to my graduation as a friend and was denied a visa. We completely forgot about that when preparing for this interview. Now I'm lost. What should I do?

Like I said, other option would be for you to marry in his country and then apply for the CR-1 spouse visa.

I think there is more to this than you might know.  Did your fiance receive any paperwork after?  Did the officer say anything?  Are there red flags like age difference, culture difference, language barriers, former marriages?

I suggest you use the advanced search tool, type it "K1 Visa denied" and read the dozens of posts of others who have been denied.  There is a plethora of information as to why visas could possibly be denied in those prior posts. Pay particular attention to others who have been denied from your same consulate.   Red flags, prior denials, things you didn't know, interview questions answered incorrectly, etc, etc.   

Take time go over the interview in great detail with your fiance.

None of those things mentioned. The paperwork he received says he his not eligible and they will return the petition to USCIS

How long those it take to return the petition to uscis? Anyone knows?

That's what everyone's says.  They don't give reasons, you have to figure it out unfortunately.

Doesn't matter it will be left to expire.

Then your hope for a K-1 is gone.  The petition will be returned to USCIS, and it will expire there.  There will no appeal, no additional interview.  You now have 2 options:

 

1.  Move to your fiance's country and live.

2.  Marry your fiance in his country (or another country other than the US), and file for a CR-1.

 

However, not even a CR-1 is guaranteed to get him into the US if he is inadmissible for some reason of which you are not aware.

This is the wording that you need to focus on. Why is he NOT ELIGIBLE? If there's something about the K1 visa that makes him not eligible, it's possible that the same reason could make him not eligible for a CR1 visa either. 

You need to figure out what makes him not eligible - if it was misrepresentation (leaving out the previous visa attempt - you said he indicated you were a "friend" on a previous visa attempt - maybe they think he was lying) or if it is some other reason he is not eligible. 

 

You have to figure out a way around that before you get married and apply CR1. How do you feel about just moving to Ghana?
