AOS from F1 visa -EAD with OPT or with AOS need help!

Hello everyone,

I m currentyl an F1 student graduating in May 2018 .I got married last week.

I am eligible to apply for OPT thourgh my university , this will give me an EAD ,work authorization but I can't apply untill May .I m preparing documents for my AOS that I intend to file in March but I am confused to apply for EAD too with my green card application , or since i am applying for OPT I don't have to apply for EAD twice .

Thanks soo much I realy need some help on what to do , I dont want to apply twice for work authorization (pay twice the fees ) and I dont want to miss the opportunity use my OPT since its going to be a faster process (ususaly less than two months ) ???

You should just apply for AOS, there’s a chance you will get EAD in May/June.

once you concurrently file for AOS and pay AOS fee you don’t have to pay the fee for EAD.

to AOS you will need to file I-485, I-865, I-765 and optionally I-131

What about i130 and 130a? 

 

I am in the same situation here. By the way, Leopeace I am not sure you cannot apply for OPT before May.  But yes, I came to the conclusion that it would make more sense just applying for AOS.

Yes, you are correct about I-130. I’m not familiar with 130a because I think it was introduced this year(?) and I filled for AOS in 2017 :) so hopefully someone more competent will respond. There are guides on visa journey regarding AOS but not specifically from student visa/visitors visa
