I would caution about what the non US spouse shares when entering the US. My spouse and I got married almost 10 years ago. We both lived in Canada. At that time we had no intention of moving to the US. However, if we had told customs about getting married they might have been afraid we were looking to AOS (adjustment of status) after the wedding. It might be worth traveling with proof of ties to Australia in case asked.

I just entered on a regular B2 visa and got married in Vegas. I am sure it might depend on the jurisdiction as to how to acquire a marriage license. In Vegas we took the bus down to the place to file for a marriage license a couple days before our wedding. We had planned everything else ahead of time but I believe they required to see the both of us in person for the license.
