Permanent Resident petitioning spouse and his children (split)

Hello,

 

I would like to petition my husband who lives outside the US. He has two children and four adopted children. Can I petition the adopted children too and should I file a separate I-130 for each of the children?

Were the adopted children adopted legally and do they have either of their parents living?

Were they official adoptions? Are the parents of the children still alive?

Their mother is alive and they were adopted legally.

If the parents are alive that may pose an issue with immigrating them. Were the parents deemed incapable of caring for the child by officals when the children were adopted?

 

Many people don't understand that, while you can adopt a child for various reasons in other countries, immigration benefits may not always be granted to the child because of that adoption. 

 

Immigration is very strict on petitioning children that have been adoption and one of the restrictions is that the parents must be either deceased or deemed unfit to care for the child(ren).
