Hi

i need to ask about 90 days stay with I-94(visa waiver program). My mom will be coming to L.A in CA from japan to help me and care of my daughters because I will attend grad school starting on August. How many times can she visit us with only I-94 per year? I want her to help us twice a year for 2 years but I heard that even she has round way airplane tickets, immigration officers may doubt her if she lives in the u.s. .  One of my daughter has disability so I need her help to go to school and change my lifer better.

Maybe one 6 months visit per year. Is your mom unemployed?

1. Providing child care is considered work (whether it's paid or not). This is not permitted on an ESTA.
2. There is no fixed amount of time that somebody can be within the US in a year on an ESTA. They cannot stay past their I-94 (90 days for ESTA) on any single visit. Entry is at the discretion of the CBP officer. Visiting too often or for too long will raise scrutiny.
   1. Generally, one should spend at least as long outside the US as in it, with twice as long being preferred.

ESTA is limited to 90 days per visit, and cannot be extended.

i will let her know that it’s too risky to stay here for 90 days to re enter the u.s and re consider what she should do.

You already said you need her to look after the kids while you’re studying. As Geowrian already noted above, that is considered work, even if she’s not getting paid.  I totally sympathize with your situation and it is great that you want to study further and better your circumstances. Unfortunately unless your mom gets a green card, she’s not going to be able to be the one to help you out the way you need.

It doesn’t matter that she won’t be paid, the fact is if she wasn’t coming to care for them so you can go back to school then you would have to pay someone to do it so the us govt sees that as taking work away from someone. 

 

Have you looked into day care on campus, ours has a children’s school on campus for kids under 5 and students get subsidized rates.
