I am married to a US citizen. We have been married here in Nigeria since 2010 and she returned home after wedding. The USCIS completed our process but in 2016 my day of interview, I was denied my visa. Reasons - 3yr tax paper, phone record, pics taken before wedding, and divorce paper was not provided. All of these can not be provided till present because now my wife is aging and can not work again, our pics before wedding was lost at the airport and for phone records, basically we do not communicate from one number. Please advice on what to do, I have missed my wife for 10yrs now, I know I can support her when I get to the USA. We need each other but I can barely get a good job here in Nigeria to support.

You did not provide what is needed to approve your visa. Until you can provide evidence of a legal, bona fide marriage and her ability to support you, you will never receive a spousal visa.  EVERYONE has to provide those basic things....and the things you listed are extremely basic parts of the process.

 

Another solution is for her to move to your country..

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The tax information requested is from the US citizen. Has she been filing taxes. 

Also, you mentioned divorce papers were not provided. You have to provide this evidence.

 

Seems you have a number of things to overcome. Until you can provide the items you were rejected for, you will not be given a visa. 

 

If if you are having difficulty obtaining theses items it is best that you seek help with it.

Lost pictures you cannot do anything about since they are gone unless you used a digital camera. If you communicate using different numbers, then you need to write a letter with your application that explains and provide the numbers. Having said that, what is the reason for different numbers?

However, the most important that your wife, a US citizen, can control is by providing the 3 years of tax information.  If your wife is no longer working and does not meet the income requirements that demonstrate that she can support you, then a sponsor will be needed.

You also mentioned that you have not seen your wife in 10 years. That could be another reason for denial. There have not been enough visits. In any event, 10 years is a very long time. Why was not the process started after the 2010 marriage?

At this point, if she is aging and cannot work, can she retire and move back to Nigeria to be with you? Hopefully, she saved enough money and can have her benefits direct-deposited while in Nigeria. 

In any event, you have to provide the supporting evidence that is required. Also, if your case was rejected in 2016, what have you and your wife been doing to rectify this problem? We are now in 2018 and you are asking a question about a rejection in 2016. Have you or your wife contacted a lawyer or at least sought the help of some organization that assists in matters like this?

If you’ve been married for eight years, you should have tons of evidence. How about emails and chat logs? Provide boarding passes and pictures from visits you’ve had the last eight years. What about birthday cards and Christmas cards sent to each other? 

 

If your wife is not working, she either needs three times the poverty guidelines in assets or a joint sponsor.

 

Also, if one of you is divorced, you have to provide the divorce papers.

No amount of sympathy for you circumstances will change the requirements.  No reasons or excuses for something not being available will change the requirements either.  It sounds like the US Citizen Petitioner is a much older woman than the Nigerian male.  This also can be an issue.  Maybe Google the words "Are Older Women Marrying Younger Men Discriminated Against?"

This totally rubbish,you been in relationship for 10years now,you don't even have any evidence,I meet my wife thru friend of mine,I proposal to her and she accept me,we do court  in 2015,she spend 2weeks with me in Nigeria before going back in 2016 we did our traditional wedding,she spend 3month with me before she went back,we have joint sponsor like land and bank account together,we chat,video,email and whatsApp together every single day and she older than me with 27 years,thank God we are together In happy married life,how could you tell us that you don't have any evidence,my brother you're not serious at all.

Your message was helpful, I mentioned the earlier message, situation here in Nigeria in regards financial instability . Please can you mention one or two of these organizations that assist in matters like this ? I can not afford to pay a lawyer

My marriage is 8 not 10, sorry. She left Nigeria for the states and we have not been together because our papers were processed within the period of 2010 - 2016, I was called for interview 2016 and I was denied my visa die to the above reasons in my earlier message. My wife is 58 now. Her tax is poor probably one of reasons for the denial of my visa too. Please advice can I file for a visiting ?is there  Any other way ?

How old are you?  It is a huge issue that you appear to not have seen your wife in 8 yaers. 

 

You  may file for a visiting visa, but then what?  You cannot live in the US, you will have to return to Nigeria.  Best to fix the immigrant visa.

No, there is not another way.  What is YOUR age?

 

That your visa process took a long time is not a reason for a couple in a legitimate relationship not to see each other.
