International travel after arrival and marriage in USA

Is anyone familiar with the restrictions on international travel after my fiance arrives in USA and we are officially married?  Hoping the process is finished with her arrival to the USA in March.  We'd immediately get married, and then would like to have a symbolic ceremony in Aruba for her family from Venezuela that can't enter the USA.  We were thinking in July.

 

Is that doable?  Is she allowed to travel for something like that?  What about a honeymoon after to Europe or something?

 

Any information would be greatly appreciated.

My friend much attention because once got wife enters US on a K1 she can’t not leave US unless she has an Advance Perole.

 

Read the AOS guide and you will understand.

 

Even if you guys are married, in order to for her to leave US she has to have an Advance Perole, otherwise she won’t be able to enter US AGAIN.

 

AOS is the second phase of your paper work with her after entering US.

The K1 visa is a one time entry visa.  She can then leave the USA, however she will need the proper documents to re-enter (another valid visa, Advance parole or her Green card).   Do not plan any international trip for a few months after you file for adjustment of status; do not spend money on non-refundable tickets until then.

She cannot leave the USA until she receives advance parole or  her greencard

She can leave at any time, many do.  She needs documents to re-enter.

Wow...  That is a pretty bold statement.  Just to clarify, she won't be able to reenter the USA on THAT (K-1) visa without advance parole.

Yes, she cannot re-enter on that visa and would need another to come back in

She will either need AP (which is authorization to reenter the US after traveling abroad) or a green card. The original K1 visa is a one time use and it is no longer valid the second she enters the US.

 

OP should plan his trips accordingly. It is taking up to 4 months to receive AP after filing AOS.

 

The absolute b st advice is to not even buy tickets until AP or green card is in her hands. Even if it means delaying the ceremony abroad.

no restriction on leaving us.  leave without ap or green card, then will need another visa to come back to us.

 

the process is not finished with her arrival to the USA in March.  she need AOS for green card.

 

Ur plan is not doable.  She can leave, but she can not come back without AP, Green card, or CR-1 spousal immigration visa.

Thank you all for the information.  After official marriage in USA, how long does it take to get the advanced parole?  I see one mention of four months.

 

If I'm interpreting correctly, it seems like that is natural paperwork to file for anyway after marriage.

Right now filing the EAD/AP (I-765, I-131) application is taking upwards of over 100 days to 140 days. Seems the 90 days or less days are gone for now due to the backlog.

Do NOT make her go on any trip abroad until she files for AOS (including AP/EAD forms) and receives in hand AP or Green Card. She will be able to leave U.S but on her return back I doubt she will be allowed back at POE. Unfortunately a lot of people think that the immigration journey stops when immigrant arrives to US. When actually that is when fun begins.

Oh yes, you still havea long way to go, the K-1 was only to enter the country. She then have to adjust her status so she can become a legal permanent resident and get a greencard. File for AOS right after you get married and have your marriage certificate, when you file for AOS also file for EAD (so she can work if she wants to while waiting for the greencard) and the AP (so she can travel abroad and be let back into the US while waiting for her greencard), those two takes about 4-5 months atm, but processing times may change. Getting the greencard can take anything between 2 months to over a year (and in extreme cases even longer than that).

A couple of years after she receives her first greencard (conditional greencard) she will have to remove the conditions (process called ROC). And after that she can also file for citizenship if she wants to.

 

So yes, you have more work to do.

Come on, we all know what T_P meant within the context of the post.  Note that there is a difference between saying "again" and "ever again."  "Again" by itself meaning a second time, in this case inference to the K-1.   And "ever again" which has a much broader meaning of any time in the future.  But also in fairness you do run the small risk that if you leave without AP or AOS, you may never get to come back again.  Getting approved for a 2nd visa is not a guarantee.
